AN ACT 1 Amending the act of December 10, 1968 (P.L.1158, No.365), 2 entitled "An act creating and establishing the Legislative 3 Data Processing Committee: providing for its membership; 4 prescribing its powers, functions and duties; and making an 5 appropriation," providing for access to computer information 6 systems by persons outside the General Assembly. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 2 of the act of December 10, 1968 10 (P.L.1158, No.365), entitled "An act creating and establishing 11 the Legislative Data Processing Committee: providing for its 12 membership; prescribing its powers, functions and duties; and 13 making an appropriation," is amended to read: 14 Section 2. The committee shall have the following powers and 15 duties: 16 (1) To establish and operate a legislative data processing 17 center incorporating a system or systems which will be capable 18 of storing and retrieving all of the financial, factual,
1 procedural and legal information necessary to serve all of the 2 committees, officers and agencies of the General Assembly. 3 (2) To provide access to computer information systems 4 operated by the committee to persons outside the General 5 Assembly as the committee deems appropriate. Such access will be 6 provided in the manner approved by the committee. No information 7 residing in the computer information systems operated by the 8 committee shall be released or disseminated to persons outside 9 the General Assembly without the approval of: 10 (i) The legislative service agency or office which 11 originated, prepared, generated or maintains the information in 12 the form released or disseminated regardless of the source of 13 the information. This information includes, but is not limited 14 to, constitutions, statutes, bills or other documents subject to 15 action by the General Assembly, legislative histories, calendars 16 and journals, rules and regulations of the executive branch and 17 reports or other publications of the legislative service agency 18 or office. 19 (ii) The Senate Committee on Management Operations if the 20 information was originated, prepared, generated or maintained in 21 whole or in part by the Senate and is not subject to 22 subparagraph (i). 23 (iii) The Bi-partisan Management Committee of the House of 24 Representatives if the information was originated, prepared, 25 generated or maintained in whole or in part by the House of 26 Representatives and is not subject to subparagraph (i). 27 [(2)] (3) To appoint and employ an executive director, who 28 shall be the chief executive officer of the committee, and such 29 other personnel as the committee may deem necessary in the 30 performance of its duties and to fix the compensation of such 19950H2046B2545 - 2 -
1 executive director and other personnel. 2 [(3)] (4) To enter into contracts for the services of such 3 professional, expert or technical services as the committee may 4 deem necessary in the performance of its duties. 5 [(4)] (5) To purchase or rent such equipment and supplies as 6 the committee may deem necessary in the performance of its 7 duties. 8 [(5)] (6) To select its own chairman, vice-chairman and such 9 other officers as the committee may deem necessary in the 10 performance of its duties. 11 [(6)] (7) To make such rules and regulations as the 12 committee may deem necessary to properly carry out the purpose 13 of the most efficient use of a legislative data processing 14 system. 15 Section 2.
