                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for insurance forms
     3     and verification of services.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4117(k) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4117.  Insurance fraud.
     9     * * *
    10     (k)  Insurance forms and verification of services.--
    11         [(1)]  All applications for insurance and all claim forms
    12     shall contain or have attached thereto the following notice:
    13             Any person who knowingly and with intent to defraud
    14             any insurance company or other person files an
    15             application for insurance or statement of claim
    16             containing any materially false information or
    17             conceals for the purpose of misleading, information
    18             concerning any fact material thereto commits a

     1             fraudulent insurance act, which is a crime and
     2             subjects such person to criminal and civil penalties.
     3         [(2)  Persons seeking payment for services or materials
     4     which will be directly or indirectly reimbursed by an insurer
     5     or a self-insured must verify, under oath, that the services
     6     and materials furnished were necessary and were, in fact,
     7     furnished. The furnishing of such verification shall be a
     8     condition precedent to payment by the insurer and to recourse
     9     against the insured by the person seeking payment.]

    11     Section 2.  This act shall take effect in 60 days.
