AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for penalties for driving under
3 the influence of alcohol or a controlled substance.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 3731 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 3731. Driving under influence of alcohol or controlled
9 substance.

11 (e.1) Repeated offense penalty.--For a second or subsequent
12 offense under this section, the arresting officer shall impound
13 the subject vehicle at the site of the alleged violation. A
14 hearing shall be held within five business days from the date of
15 arrest where a judge shall determine whether the vehicle is to
16 be returned to its owner or forfeited to the Commonwealth.
