                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, requiring vehicle rental agencies to offer optional
     3     child passenger restraint systems to all customers; and
     4     providing for the purchase of child passenger restraint
     5     systems.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 4581 of Title 75 of the Pennsylvania
     9  Consolidated Statutes is amended by adding a subsection to read:
    10  § 4581.  Restraint systems.

    12     (i)  Vehicle rental agencies.--Each automobile and light
    13  truck rental agency shall offer optional child passenger
    14  restraint systems to every customer. Agency rental forms will
    15  include a check-off which will permit a customer to refuse the
    16  optional child passenger restraint system. The failure of any
    17  automobile or light truck rental agency to comply with the
    18  provisions of this subsection is a summary offense, and the

     1  penalty provisions of subsection (b) shall apply.
     2     Section 2.  Section 4582 of Title 75 is amended to read:
     3  § 4582.  Child Passenger Restraint Fund.
     4     A Child Passenger Restraint Fund is established in the
     5  General Fund as a special restricted receipts account hereby
     6  earmarked for and appropriated to the department. This fund
     7  shall consist of all fines deposited pursuant to section 4581(b)
     8  (relating to restraint systems), all Federal funds granted for
     9  said use and any moneys donated into the fund. All such funds
    10  shall be used solely for the purpose of purchasing Federally
    11  approved child restraint seats and making such seats available
    12  to qualified loaner programs within the Commonwealth. A
    13  qualified loaner program shall be one determined by the
    14  department to loan Federally approved child restraint seats to
    15  parents or legal guardians of children under four years of age
    16  who, due to financial or economic hardship, are unable to comply
    17  with the provisions of this subchapter. Any automobile or light
    18  truck rental agency may purchase approved child restraint seats
    19  from the fund, provided that the agency offers that child
    20  restraint seat to rental customers free of charge. The
    21  department shall adopt such regulations as are necessary to
    22  effectuate the purpose of this section.
    23     Section 3.  This act shall take effect in 60 days.
