                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for dirt and gravel road maintenance.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 9102(a) of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 9102.  Distribution of State highway maintenance funds.
     8     (a)  General rule.--[The] Except as provided under sections
     9  9106 (relating to dirt and gravel road maintenance) and 9107
    10  (relating to State forestry roads), the department shall
    11  distribute all highway appropriations and executive
    12  authorizations for State highway maintenance in the various
    13  county maintenance districts in the following manner:
    14         (1)  For any fiscal year in which the total highway
    15     maintenance appropriations and executive authorizations are
    16     equal to the combined total base allocations for all the
    17     county maintenance districts, each maintenance district shall

     1     receive its base allocation.
     2         (2)  For any fiscal year in which the total highway
     3     maintenance appropriations and executive authorizations are
     4     less than the combined total base allocations of all the
     5     county maintenance districts, each maintenance district's
     6     share shall be reduced, to the extent necessary to bring the
     7     total allocation within the funding limits, in the same
     8     proportion that each county's base allocations bears to the
     9     combined total of all counties' base allocations.
    10         (3)  For any fiscal year in which the total highway
    11     maintenance appropriations and executive authorizations are
    12     greater than the combined total base allocations of all the
    13     county maintenance districts, the funds shall be distributed
    14     based upon the formula in subsection (b), but notwithstanding
    15     the formula calculation for any particular county, no county
    16     shall receive less than its base allocation in any year.

    18     Section 2.  Title 75 is amended by adding sections to read:
    19  § 9106.  Dirt and gravel road maintenance.
    20     (a)  General rule.--The department shall annually distribute
    21  $7,000,000 of the total funds available under section 9102
    22  (relating to distribution of State highway maintenance funds) to
    23  municipalities for the mitigation of sediment runoff from
    24  locally owned dirt and gravel roads.
    25     (b)  Application.--Municipalities may apply for funding each
    26  year in blocks of $5,000 per mile. A municipality may receive a
    27  maximum of $10,000 per year in funding. An application to the
    28  department's district municipal services supervisors must
    29  contain letters from the local county conservation district and
    30  the Pennsylvania Fish and Boat Commission in support of the

     1  particular project.
     2     (c)  Training.--The Department of Environmental Resources or
     3  the department shall conduct or preapprove a one-week training
     4  course for municipal employees on how to mitigate the sediment
     5  runoff from dirt and gravel roads. The department shall provide
     6  $250 per person for the training course and a maximum of $400
     7  for expenses.
     8     (d)  Priorities.--The department shall prioritize funding for
     9  roads located along streams of high quality and exceptional
    10  value. The department shall also prioritize funding for those
    11  municipalities that have received training.
    12  § 9107.  State forestry roads.
    13     (a)  General rule.--The department shall annually distribute
    14  $2,000,000 of the total funds available under section 9102
    15  (relating to distribution of State highway maintenance funds) to
    16  the Department of Environmental Resources for the mitigation of
    17  sediment runoff from State forestry roads.
    18     (b)  Priorities.--The Department of Environmental Resources
    19  shall prioritize funding for dirt and gravel roads located along
    20  streams of high quality and exceptional value.
    21     Section 3.  This act shall take effect in 60 days.
