AN ACT 1 Amending Title 51 (Military Affairs) of the Pennsylvania 2 Consolidated Statutes, further providing for THE APPOINTMENT <-- 3 OF ASSISTANT ADJUTANT GENERALS AND FOR the pay of officers 4 and enlisted personnel. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 3102 of Title 51 of the Pennsylvania <-- 8 Consolidated Statutes is amended to read: 9 SECTION 1. SECTIONS 901(A) AND 3102 OF TITLE 51 OF THE <-- 10 PENNSYLVANIA CONSOLIDATED STATUTES ARE AMENDED TO READ: 11 § 901. APPOINTMENT OF ADJUTANT GENERAL, DEPUTIES AND 12 ASSISTANTS. 13 (A) APPOINTMENT.--THE GOVERNOR SHALL APPOINT THE ADJUTANT 14 GENERAL WITH THE ADVICE AND CONSENT OF THE SENATE. THE ADJUTANT 15 GENERAL MAY APPOINT A DEPUTY ADJUTANT GENERAL FOR ARMY AND A 16 DEPUTY ADJUTANT GENERAL FOR AIR, AND SUCH OTHER DEPUTY ADJUTANTS
1 GENERAL AND ASSISTANT ADJUTANTS GENERAL AS IN HIS DISCRETION ARE 2 NEEDED FOR THE EFFICIENT FUNCTIONING OF THE DEPARTMENT. THE 3 POSITIONS OF ASSISTANT ADJUTANT GENERAL, ARMY, AND ASSISTANT 4 ADJUTANT GENERAL, AIR, IN THE GRADES OF BRIGADIER GENERAL OR 5 MAJOR GENERAL, SHALL BE AUTHORIZED. DEPUTY ADJUTANTS GENERAL AND 6 SUCH ADDITIONAL ASSISTANT ADJUTANTS GENERAL AS MAY BE REQUIRED 7 MAY ALSO HAVE AT LEAST THE RANK OF BRIGADIER GENERAL IN THE 8 PENNSYLVANIA NATIONAL GUARD OR PENNSYLVANIA GUARD AFTER 9 APPOINTMENT. 10 * * * 11 § 3102. Pay of officers and enlisted personnel in active State 12 service. 13 (a) General rule.--When the Pennsylvania National Guard or 14 Pennsylvania Guard, or any part thereof, is ordered on active 15 duty for State service by the Governor as Commander-in-Chief and 16 pay is authorized for such duty under the order prescribing the 17 performance thereof, the commissioned officers, warrant officers 18 and enlisted personnel so ordered shall be entitled to the same 19 pay and allowances and transportation in kind provided for in 20 the current Armed Forces Pay and Allowance Act. Notwithstanding 21 any provisions of such act, the pay of any such personnel shall 22 not be less than [$45] $75 per day. 23 (b) Payments and deductions.--All payments of pay and 24 service shall be made by the Adjutant General in the usual 25 manner. No deductions shall be made from the pay of officers or 26 enlisted personnel in active State service for dues or other 27 financial obligations imposed by any bylaws, rules or 28 regulations of a civil character. 29 Section 2.
