                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for taxation by
     6     second, third and fourth class school districts.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 672 of the act of March 10, 1949 (P.L.30,
    10  No.14), known as the Public School Code of 1949, is amended by
    11  adding a subsection to read:
    12     Section 672.  Tax Levy; Limitations.--* * *
    13     (f)  (1)  Unless voter approval by referendum is obtained, a
    14  school district of the second, third or fourth class may not
    15  establish a total millage rate which exceeds the millage rate
    16  for the same school district during the current fiscal year by
    17  an amount which exceeds the rate of inflation determined from
    18  the Consumer Price Index for the immediately preceding twelve-
    19  month period.


     1     (2)  The board of school directors of a school district of
     2  the second, third or fourth class shall be responsible for
     3  submitting the referendum question to the county board of
     4  elections for a vote in the primary election to be held
     5  immediately preceding the new fiscal year for the school
     6  district.
     7     (3)  The referendum question shall include the proposed
     8  millage rate for the upcoming fiscal year.
     9     Section 2.  This act shall apply to fiscal years beginning on
    10  or after July 1, 1995.
    11     Section 3.  This act shall take effect immediately.
