SENATE RESOLUTION

No. 43 Session of 1993


        INTRODUCED BY LEWIS, GREENLEAF, AFFLERBACH, O'PAKE, SHUMAKER,
           REIBMAN, STAPLETON, FATTAH, MUSTO, LAVALLE, PUNT, PECORA,
           SALVATORE, LEMMOND AND HART, APRIL 19, 1993

        REFERRED TO JUDICIARY, APRIL 19, 1993

                            A CONCURRENT RESOLUTION

     1  Directing the Joint State Government Commission to study on an
     2     ongoing basis legislative proposals involving domestic
     3     relations law and creating a task force.

     4     WHEREAS, Numerous legislative proposals are from time to time
     5  before the General Assembly which would amend Title 23 (Domestic
     6  Relations) of the Pennsylvania Consolidated Statutes; and
     7     WHEREAS, Many other issues, not in legislative form, relating
     8  to domestic relations law have come to the attention of the
     9  General Assembly; and
    10     WHEREAS, These proposals and issues raise significant
    11  substantive and technical concerns regarding domestic relations
    12  law; and
    13     WHEREAS, Since Pennsylvania's domestic relations laws
    14  recently have been consolidated in Title 23 (Domestic Relations)
    15  of the Pennsylvania Consolidated Statutes as the Domestic
    16  Relations Code, there is a need for a more coordinated review of
    17  any proposed amendments in order to maintain the systemic
    18  integrity of the Domestic Relations Code; and

     1     WHEREAS, The various issues before the General Assembly
     2  require a bicameral and bipartisan review and response;
     3  therefore be it
     4     RESOLVED (the House of Representatives concurring), That the
     5  General Assembly direct the Joint State Government Commission to
     6  undertake an ongoing study of the various issues relating to
     7  domestic relations law; and be it further
     8     RESOLVED, That to accomplish this goal, a task force be
     9  created comprised of the majority chairman of the Judiciary
    10  Committee of the Senate and the majority chairman of the
    11  Judiciary Committee of the House of Representatives, who shall
    12  alternate chairmanship of the task force, the minority chairman
    13  of the Judiciary Committee of the Senate, the majority and
    14  minority chairmen of the Aging and Youth Committee of the
    15  Senate, the majority and minority chairmen of the Judiciary
    16  Committee of the House of Representatives and the majority and
    17  minority chairmen of the Aging and Youth Committee of the House
    18  of Representatives; and be it further
    19     RESOLVED, That an advisory committee be created to assist the
    20  task force composed of individuals deemed appropriate by the
    21  task force; and be it further
    22     RESOLVED, That the task force shall, from time to time,
    23  present its findings and recommended legislation to the General
    24  Assembly.
