                                     AN ACT

     1  Amending the act of April 4, 1984 (P.L.193, No.40), entitled "An
     2     act requiring certain public agencies in the Commonwealth of
     3     Pennsylvania to purchase or lease motor vehicles which are
     4     manufactured or assembled in the United States; and imposing
     5     a penalty," further providing for purchase or lease of
     6     certain motor vehicles.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 5 of the act of April 4, 1984 (P.L.193,
    10  No.40), known as the Motor Vehicle Procurement Act, amended May
    11  16, 1985 (P.L.37, No.18), is amended to read:
    12  Section 5.  Contract provisions.
    13     (a)  Motor vehicles to be manufactured in North America.--A
    14  public agency shall procure only motor vehicles which are
    15  manufactured in North America. A motor vehicle is manufactured
    16  in North America if a substantial majority of the principal
    17  components are assembled into the final product in an assembly
    18  plant in North America. Contract documents for the procurement
    19  of motor vehicles shall contain a provision that the vehicles


     1  procured by the public agency shall be manufactured in North
     2  America.
     3     (b)  Exception.--This section shall not apply:
     4     (1)  where the head of the public agency shall state in
     5  writing that it is inconsistent with the public interest or that
     6  the cost is unreasonable[.]; or
     7     (2)  as to the procurement of a motor vehicle designed
     8  primarily for use in construction or agriculture or road
     9  maintenance such as tractors and earth-moving equipment, where
    10  the manufacturer of such vehicle has its principal place of
    11  business in this Commonwealth, has at least 1,000 employees in
    12  this Commonwealth and pays more than $1,000,000 annually in
    13  Pennsylvania corporate taxes, including the corporate net income
    14  tax and the capital stock and franchise tax.
    15     Section 2.  This act shall take effect in 60 days.
