AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, FURTHER PROVIDING FOR WIRETAPPING AND <-- 3 ELECTRONIC SURVEILLANCE; AND prohibiting the sale of certain 4 beverages to persons under 21 years of age. 5 The General Assembly finds and declares as follows: 6 The youth of Pennsylvania are the greatest resource of this 7 Commonwealth and the Commonwealth finds that the protection of 8 minors from the possible abuse of alcohol is of great 9 importance. 10 The Commonwealth seeks to prevent minors from using alcoholic 11 products. Nonalcoholic beer, wine and liquor contain amounts of 12 alcohol and often taste, look and smell like legitimate 13 alcoholic products. Therefore, the Commonwealth has a purpose in 14 the restriction of sales of these products to minors. 15 Nonalcoholic beverages are made for those who want to enjoy 16 the taste of alcohol without the effects of alcohol and should 17 never be intended to introduce the youth of this Commonwealth to
1 drinking beer, wine or liquor. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 Section 1. Title 18 of the Pennsylvania Consolidated <-- 5 Statutes is amended by adding a section to read: 6 SECTION 1. SECTION 5781 OF TITLE 18 OF THE PENNSYLVANIA <-- 7 CONSOLIDATED STATUTES IS AMENDED TO READ: 8 § 5781. EXPIRATION OF CHAPTER. 9 THIS CHAPTER EXPIRES DECEMBER 31, [1994] 1999, UNLESS 10 EXTENDED BY STATUTE. 11 SECTION 2. TITLE 18 IS AMENDED BY ADDING A SECTION TO READ: 12 § 6310.7. Selling or furnishing nonalcoholic beverages to 13 persons under 21 years of age. 14 (a) Offense defined.--A person commits a summary offense if 15 he intentionally and knowingly sells or furnishes nonalcoholic 16 beverages to any person under 21 years of age. 17 (b) Definitions.--As used in this section, the term 18 "nonalcoholic beverage" means any beverage intended to be 19 marketed or sold as nonalcoholic beer, wine or liquor having 20 some alcohol content but does not contain more than 0.5% alcohol 21 by volume. 22 Section 2. This act shall take effect in 60 days. <-- 23 SECTION 3. THIS ACT SHALL TAKE EFFECT AS FOLLOWS: <-- 24 (1) THE ADDITION OF 18 PA.C.S. § 6310.7 SHALL TAKE 25 EFFECT IN 60 DAYS. 26 (2) THE REMAINDER OF THIS ACT SHALL TAKE EFFECT 27 IMMEDIATELY.
