AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, prohibiting the sale of certain 3 beverages to persons under 21 years of age. 4 The General Assembly finds and declares as follows: 5 The youth of Pennsylvania are the greatest resource of this 6 Commonwealth and the Commonwealth finds that the protection of 7 minors from the possible abuse of alcohol is of great 8 importance. 9 The Commonwealth seeks to prevent minors from using alcoholic 10 products. Nonalcoholic beer, wine and liquor contain amounts of 11 alcohol and often taste, look and smell like legitimate 12 alcoholic products. Therefore, the Commonwealth has a purpose in 13 the restriction of sales of these products to minors. 14 Nonalcoholic beverages are made for those who want to enjoy 15 the taste of alcohol without the effects of alcohol and should 16 never be intended to introduce the youth of this Commonwealth to
1 drinking beer, wine or liquor. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 Section 1. Title 18 of the Pennsylvania Consolidated 5 Statutes is amended by adding a section to read: 6 § 6310.7. Selling or furnishing nonalcoholic beverages to 7 persons under 21 years of age. 8 (a) Offense defined.--A person commits a summary offense if 9 he intentionally and knowingly sells or furnishes nonalcoholic 10 beverages to any person under 21 years of age. 11 (b) Definitions.--As used in this section, the term 12 "nonalcoholic beverage" means any beverage INTENDED TO BE <-- 13 MARKETED OR SOLD AS NONALCOHOLIC BEER, WINE OR LIQUOR having 14 some alcohol content but does not contain more than 0.5% alcohol 15 by volume. 16 Section 2.
