AN ACT
1 Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
2 "An act concerning elections, including general, municipal,
3 special and primary elections, the nomination of candidates,
4 primary and election expenses and election contests; creating
5 and defining membership of county boards of elections;
6 imposing duties upon the Secretary of the Commonwealth,
7 courts, county boards of elections, county commissioners;
8 imposing penalties for violation of the act, and codifying,
9 revising and consolidating the laws relating thereto; and
10 repealing certain acts and parts of acts relating to
11 elections," changing the day for nonpresidential general
12 primaries and municipal primaries.
13 The General Assembly of the Commonwealth of Pennsylvania
14 hereby enacts as follows:
15 Section 1. Section 603 of the act of June 3, 1937 (P.L.1333,
16 No.320), known as the Pennsylvania Election Code, amended
17 October 12, 1990 (P.L.534, No.131), is amended to read:
18 Section 603. General Primary; Candidates to Be Nominated and
19 Party Officers to Be Elected.--(a) There shall be a General
20 primary preceding each general election which shall be held on
21 the [third Tuesday of May] Tuesday following the second Monday
1 in September in all even-numbered years, except in the year of 2 the nomination of a President of the United States, in which 3 year the General primary shall be held on the fourth Tuesday of 4 April. If the Tuesday following the second Monday in September 5 falls on a Jewish holiday, the primary election shall be held on 6 the second Monday of September. Candidates for all offices to be 7 filled at the ensuing general election shall be nominated at the 8 General primary. The vote for candidates for the office of 9 President of the United States, as provided for by this act, 10 shall be cast at the General primary. 11 [(b.1) Notwithstanding subsection (a), the General primary 12 for 1994 shall be held on May 10, 1994.] 13 Section 2. Section 604 of the act, amended January 14, 1952 14 (1951 P.L.1937, No.540), is amended to read: 15 Section 604. Municipal Primary; Officers to be Nominated.-- 16 There shall be a Municipal primary preceding each municipal 17 election which shall be held on the [third Tuesday of May] 18 Tuesday following the second Monday in September in all odd- 19 numbered years. If the Tuesday following the second Monday in 20 September falls on a Jewish holiday, the primary election shall 21 be held on the second Monday of September. Candidates for all 22 offices to be filled at the ensuing municipal election shall be 23 nominated at the Municipal primary. 24 Section 3. This act shall take effect in 60 days.
