                                     AN ACT

     1  Amending the act of December 8, 1982 (P.L.848, No.235), entitled
     2     "An act providing for the adoption of capital projects
     3     related to the repair, rehabilitation or replacement of
     4     highway bridges to be financed from current revenue or by the
     5     incurring of debt and capital projects related to highway and
     6     safety improvement projects to be financed from current
     7     revenue of the Motor License Fund," providing for the
     8     prioritizing of bridge projects.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of December 8, 1982 (P.L.848, No.235),
    12  known as the Highway-Railroad and Highway Bridge Capital Budget
    13  Act for 1982-1983, is amended by adding a section to read:
    14  Section 6.1.  Accelerated projects.
    15     (a)  Notwithstanding the provisions of sections 2002 and 2011
    16  of the act of April 9, 1929 (P.L.177, No.175), known as The
    17  Administrative Code of 1929, projects meeting any of the
    18  following criteria will be placed on a priority list for funding
    19  under this act:
    20         (1)  traffic count of at least 2,000 vehicles per day
    21     prior to closing of or restricting of traffic on the bridge;

     1         (2)  population of at least 20,000 in the municipality
     2     affected by or the municipalities abutting the bridge; and
     3         (3)  the bridge is one of no more than three means of
     4     ingress and egress to a municipality described in paragraph
     5     (2).
     6     (b)  Bids shall be let within one month of placing a bridge
     7  on the priority list.
     8     (c)  The contract for each bridge placed on the priority list
     9  shall contain a monetary performance incentive and a monetary
    10  disincentive for nonperformance.
    11     (d)  The Pennsylvania Public Utility Commission and the
    12  Department of Environmental Resources must approve or disapprove
    13  a project on the priority list within 30 days of the filing of a
    14  request for approval. If action is not forthcoming in 30 days,
    15  approval shall not be required.
    16     Section 2.  This act shall take effect in 60 days.
