AN ACT 1 Making appropriations from the Professional Licensure 2 Augmentation Account and from restricted revenue accounts 3 within the General Fund to the Department of State for use by 4 the Bureau of Professional and Occupational Affairs in 5 support of the professional licensure boards assigned 6 thereto. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The sum of $14,801,000, or as much thereof as may 10 be necessary, is hereby appropriated from the Professional 11 Licensure Augmentation Account within the General Fund to the 12 Department of State for the operation of the Bureau of 13 Professional and Occupational Affairs, including the State Board 14 of Auctioneer Examiners, for the fiscal year July 1, 1994, to 15 June 30, 1995. 16 Section 2. (a) The sum of $2,196,000, or as much thereof as 17 may be necessary, is hereby appropriated from the restricted 18 receipts account of the State Board of Medicine, as authorized 19 by section 907(a) of the act of October 15, 1975 (P.L.390,
1 No.111), known as the Health Care Services Malpractice Act, for 2 the operation of the board for the fiscal year July 1, 1994, to 3 June 30, 1995. 4 (b) The sum of $444,000, or as much thereof as may be 5 necessary, is hereby appropriated from the restricted receipts 6 account of the State Board of Osteopathic Medicine, as 7 authorized by section 907(b) of the Health Care Services 8 Malpractice Act, for the operation of the board for the fiscal 9 year July 1, 1994, to June 30, 1995. 10 (c) The sum of $139,000, or as much thereof as may be 11 necessary, is hereby appropriated from the restricted receipts 12 account of the State Board of Podiatry, as authorized by section 13 907(c) of the Health Care Services Malpractice Act, for the 14 operation of said board for the fiscal year July 1, 1994, to 15 June 30, 1995. 16 (d) The sum of $262,000, or as much thereof as may be 17 necessary, is hereby appropriated from the Athletic Commission 18 Augmentation Account for the State Athletic Commission, as 19 authorized by 5 Pa.C.S. § 1512 (relating to Athletic Commission 20 Augmentation Account), for the support and operation of the 21 commission for the fiscal year July 1, 1994, to June 30, 1995. 22 (e) Each appropriation listed in subsections (a), (b), (c) 23 and (d) shall not be treated as an augmentation to the 24 Department of State, general government appropriation, or any 25 other appropriation, but shall be treated and accounted for as 26 separate appropriations respectively. 27 Section 3. After November 30, 1994, none of the money 28 appropriated in this act shall be paid to the Department of 29 State on account of the assessment of Department of State 30 expenses unless the Secretary of the Budget has certified by 19940H2831B3740 - 2 -
1 December 1, 1994, that procedures have been implemented to 2 assure that the assessment of Department of State expenses is in 3 compliance with section 907 of the act of October 15, 1975 4 (P.L.390, No.111), known as the Health Care Services Malpractice 5 Act, section 301 of the act of July 1, 1978 (P.L.700, No.124), 6 known as the Bureau of Professional and Occupational Affairs Fee 7 Act, and section 33 of the act of December 22, 1983 (P.L.327, 8 No.85), known as the Auctioneer and Auction Licensing Act. The 9 Secretary of the Budget shall submit the certification and a 10 summary of the implemented procedures to the chairmen and 11 minority chairmen of the Appropriations Committee and the 12 Consumer Protection and Professional Licensure Committee of the 13 Senate and the Appropriations Committee and the Professional 14 Licensure Committee of the House of Representatives and to the 15 chairman of the Legislative Budget and Finance Committee. The 16 Legislative Budget and Finance Committee shall review the 17 procedures to determine their adequacy in assuring that the 18 assessment of Department of State expenses is in compliance with 19 section 907 of the Health Care Services Malpractice Act, section 20 301 of the Bureau of Professional and Occupational Affairs Fee 21 Act and section 33 of the Auctioneer and Auction Licensing Act. 22 Section 4.
