A SUPPLEMENT 1 To the act of June 25, 1931 (P.L.1352, No.332), entitled "An act 2 providing for joint action by the Commonwealth of 3 Pennsylvania and the State of New Jersey in the 4 administration, operation, and maintenance of bridges over 5 the Delaware River, and for the construction of additional 6 bridge facilities across said river; authorizing the 7 Governor, for these purposes, to enter into an agreement with 8 the State of New Jersey; creating a Delaware River Joint Toll 9 Bridge Commission and specifying the powers and duties 10 thereof, including the power to finance the construction of 11 additional bridges by the issuance of revenue bonds to be 12 redeemed from revenues derived from tolls collected at such 13 bridges; transferring to said commission all powers now 14 exercised by existing commission created to acquire toll 15 bridges over the Delaware River; and making an 16 appropriation," providing procedures for the exercise of veto 17 power by the Governor. 18 The General Assembly of the Commonwealth of Pennsylvania 19 hereby enacts as follows: 20 Section 1. The minutes of every meeting of the Delaware 21 River Joint Toll Bridge Commission, established under the act of 22 June 25, 1931 (P.L.1352, No.332), referred to as the Delaware 23 River Joint Toll Bridge Compact, shall, as soon as possible 24 after the meeting, be delivered, by and under the certification 25 of the secretary of the commission, to the Governor of the
1 Commonwealth of Pennsylvania, at Harrisburg. 2 Section 2. Approval of minutes. 3 No action taken by a Pennsylvania commissioner at the meeting 4 shall have force or effect for a period of ten days, except 5 Saturdays, Sundays and State public holidays, after the minutes 6 have been delivered to the Governor under this act, unless the 7 Governor approves the minutes, or any part thereof, in writing, 8 by reciting the action approved, within this ten-day period. 9 This veto power shall be construed to affect the covenants 10 contained in the bonds of the commission. 11 Section 3. Return of minutes. 12 The Governor of Pennsylvania shall return the minutes to the 13 Delaware River Joint Toll Bridge, not later than the ten-day 14 period described in section 2, either with or without a veto of 15 any action recited in the minutes to have been taken by a 16 commissioner appointed from Pennsylvania. If the Governor does 17 not return the minutes within this ten-day period, the action 18 taken by the Pennsylvania commissioners shall have the force and 19 effect as recited in the minutes, according to the wording 20 thereof. 21 Section 4. Veto. 22 If the Governor of Pennsylvania, within the ten-day period 23 described in section 2, returns the minutes to the Delaware 24 River Joint Toll Bridge Commission with a veto against the 25 action of a commissioner from Pennsylvania, the action of that 26 commissioner shall be null and void and of no effect. 27 Section 5. Applicability. 28 This act shall remain inoperative until: 29 (1) The enactment of the act of (P.L. , No. ), 30 entitled "An act amending the act of June 25, 1931 (P.L.1352, 19940H2716B3599 - 2 -
1 No.332), entitled 'An act providing for joint action by the 2 Commonwealth of Pennsylvania and the State of New Jersey in 3 the administration, operation, and maintenance of bridges 4 over the Delaware River, and for the construction of 5 additional bridge facilities across said river; authorizing 6 the Governor, for these purposes, to enter into an agreement 7 with the State of New Jersey; creating a Delaware River Joint 8 Toll Bridge Commission and specifying the powers and duties 9 thereof, including the power to finance the construction of 10 additional bridges by the issuance of revenue bonds to be 11 redeemed from revenues derived from tolls collected at such 12 bridges; transferring to said commission all powers now 13 exercised by existing commission created to acquire toll 14 bridges over the Delaware River; and making an 15 appropriation,' further providing for attendance at meeting, 16 for a limitation on certain employment, for veto powers of 17 the Governors and for joint audits." 18 (2) The enactment of similar legislation to that 19 described in paragraph (1) by the State of New Jersey. 20 (3) The approval by the Congress of the United States, 21 if necessary, of the amendments to the compact described in 22 paragraphs (1) and (2). 23 Section 6.
