AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for the seating of students on
3 school buses.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 4551 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 4551. Safety regulations.
9 (a) General rule.--All school buses and all other vehicles
10 used in the transportation of school children, owned by or under
11 contract with any school district or parochial or private
12 school, shall conform to standards prescribed by the department.
13 Regulations shall be promulgated by the department governing the
14 safe design, construction, equipment and operation of vehicles
15 engaged in the transportation of school children. The
16 regulations of the department shall specify that school children
17 attending kindergarten through sixth grade may be transported
18 three to a seat in a school bus. All other school children shall
1 only be transported two to a seat in a school bus.
2 (b) Violation and penalty.--No person shall operate or
3 permit the operation of a vehicle of a type specified in this
4 subchapter which is not in compliance with the requirements of
5 this subchapter or applicable regulations issued under this
6 subchapter. Violation of this section constitutes a summary
7 offense punishable by a fine of not less than $50 nor more than
8 $100.
9 Section 2. This act shall take effect in 60 days.
