                                     AN ACT

     1  Amending the act of December 16, 1986 (P.L.1646, No.188),
     2     entitled "An act providing for the licensing of chiropractors
     3     and the regulation of the practice of chiropractic;
     4     establishing the State Board of Chiropractic in the
     5     Department of State and providing for its powers and duties;
     6     providing for the supervision of colleges of chiropractic,
     7     for the examination of applicants, for enforcement and for
     8     disciplinary actions; providing penalties; and making
     9     repeals," further providing for approval of chiropractic
    10     colleges.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 303(b) of the act of December 16, 1986
    14  (P.L.1646, No.188), known as the Chiropractic Practice Act, is
    15  reenacted and amended to read:
    16  Section 303.  Approval of chiropractic colleges.

    18     (b)  Continuation of colleges pending accreditation.--
    19         (1)  Any college which, on the effective date of [this
    20     act] the reenactment of this subsection, is not accredited as
    21     provided in subsection (a) but which has been approved by the


     1     board on the basis of a self-study and inspection or has
     2     current status as a recognized candidate for accreditation as
     3     provided in subsection (a) or whose graduates were admitted
     4     to the most recent examination for licensure under the act of
     5     August 10, 1951 (P.L.1182, No.264), known as the Chiropractic
     6     Registration Act of 1951, shall have five years from the
     7     effective date of [this act] the reenactment of this
     8     subsection in which to obtain accreditation as provided in
     9     subsection (a). Such colleges shall continue to offer
    10     chiropractic training and education in accordance with the
    11     requirements of the Department of Education of the
    12     Commonwealth. The Department of Education of the Commonwealth
    13     shall periodically ascertain, by inspection and otherwise,
    14     the quality of instruction and facilities possessed by such
    15     colleges. A person shall be admitted to the licensing
    16     examination and shall be eligible for licensure if he
    17     otherwise satisfies the requirements of this act and if he
    18     graduated from any such college prior to the effective date
    19     of [this act] the reenactment of this subsection, graduated
    20     within five years from the effective date of [this act] the
    21     reenactment of this subsection, or graduated more than five
    22     years from the effective date of [this act] the reenactment
    23     of this subsection but was enrolled at such college on the
    24     expiration of five years from the effective date of [this
    25     act.] the reenactment of this subsection.
    26         (2)  This subsection shall apply to only those colleges
    27     which meet all of the following criteria:
    28             (i)  they have been in operation continuously for at
    29         least 16 years prior to the effective date of the
    30         reenactment of this subsection;

     1             (ii)  they became accredited as provided in
     2         subsection (a) no later than July 31, 1991; and
     3             (iii)  they continue to be accredited by the same
     4         chiropractic accrediting agency but are no longer
     5         included within the provisions of subsection (a) because
     6         the accrediting agency ceased to be recognized by the
     7         United States Department of Education as of June 4, 1993.
     8     Section 2.  This act shall take effect immediately.
