AN ACT 1 Amending the act of December 20, 1985 (P.L.457, No.112), 2 entitled "An act relating to the right to practice medicine 3 and surgery and the right to practice medically related acts; 4 reestablishing the State Board of Medical Education and 5 Licensure as the State Board of Medicine and providing for 6 its composition, powers and duties; providing for the 7 issuance of licenses and certificates and the suspension and 8 revocation of licenses and certificates; providing penalties; 9 and making repeals," requiring a program of continuing 10 medical education prior to biennial license renewal. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Section 25 of the act of December 20, 1985 14 (P.L.457, No.112), known as the Medical Practice Act of 1985, is 15 amended by adding a subsection to read: 16 Section 25. Licenses and certificates; biennial registration. 17 * * * 18 (e) Continuing education.--The board shall adopt, promulgate 19 and enforce rules and regulations establishing requirements for 20 continuing medical education to be met by persons licensed to 21 practice medicine without restriction. Each person licensed to
1 practice medicine and surgery without restriction, during the 2 two-year period immediately preceding a biennial date for 3 reregistering with the board, must complete a program of 4 continuing medical education, as defined by and acceptable to 5 the board. The number of hours of continuing education to be met 6 by licensees shall be set by the board by regulation. No credit 7 shall be given for any course in office management or practice 8 building. In issuing rules and regulations and individual orders 9 in respect of requirements for continuing medical education, the 10 board, in its discretion, may among other things, use and rely 11 upon guidelines and pronouncements of recognized educational and 12 professional organizations; may prescribe for content, duration 13 and organization of courses; shall take into account the 14 accessibility of such continuing education; may waive such 15 requirements in instances of individual hardship where good 16 cause is shown and the board finds that the public's safety and 17 welfare are not jeopardized by the waiver of such requirements; 18 and shall waive such requirements with respect to retired 19 physicians not engaged in the active practice of medicine and 20 surgery. 21 Section 2.
