                                     AN ACT

     1  Amending the act of July 9, 1990 (P.L.340, No.78), entitled "An
     2     act providing for a Statewide emergency telephone number 911
     3     system; providing for contributions from telephone
     4     subscribers; providing a penalty; and making a repeal,"
     5     further providing for counties.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 4(c) of the act of July 9, 1990 (P.L.340,
     9  No.78), known as the Public Safety Emergency Telephone Act, is
    10  amended to read:
    11  Section 4.  Counties.

    13     (c)  Cities of the second class, second class A and third
    14  class and certain boroughs.--Any city of the second class,
    15  second class A or third class and any borough with a population
    16  greater than 10,000 that has established a 911 system prior to
    17  the effective date of this act may exercise the powers and
    18  duties of counties under this act. Any city of the second class,
    19  second class A or third class and any borough with a population

     1  greater than 10,000 that has not established a 911 system prior
     2  to the effective date of this act may exercise the powers and
     3  duties of counties under this act only when the county has
     4  chosen not to exercise those powers and duties. The powers and
     5  duties granted to cities and boroughs under this section shall
     6  be applicable and may be exercised only within the boundaries of
     7  the city or borough. No action by a city pursuant to this
     8  section shall preempt the powers and duties of a county to
     9  establish a 911 system outside the boundaries of the city or
    10  borough at any time. The department may establish regulations
    11  governing the exercise of powers and duties granted to cities of
    12  the second class, second class A and third class and any borough
    13  with a population greater than 10,000 by this section.
    14     Section 2.  This act shall take effect immediately.
