                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, authorizing municipalities to petition the
     3     Department of Transportation for the imposition of certain
     4     restrictions on certain commercial vehicles on two-lane State
     5     roads.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 6109(d) of Title 75 of the Pennsylvania
     9  Consolidated Statutes is amended to read:
    10  § 6109.  Specific powers of department and local authorities.

    12     (d)  Prior approval by department.--
    13         (1)  Notwithstanding the provisions of subsection (a),
    14     the department may require local authorities to obtain
    15     department approval in advance of regulating traffic on
    16     State-designated highways within their physical boundaries.
    17         (2)  Local authorities may petition the department to
    18     prohibit the use of two-lane State highways by commercial
    19     vehicles with three or more axles when the particular two-

     1     lane State highway passes through a scenic, historic,
     2     residential or hazardous area. The petition shall set forth
     3     the reasons for the prohibition and reasonable alternatives
     4     for the movement of the prohibited commercial vehicles. The
     5     department shall review the petition and make its
     6     determination based on:
     7             (i)  The significance and extent of the area to be
     8         restricted.
     9             (ii)  The design and condition of the State highway.
    10             (iii)  The availability of feasible and reasonable
    11         alternate routes for the prohibited vehicles.
    12             (iv)  Any information gained from any traffic
    13         engineering study.
    14     A copy of any traffic engineering study relied on by the
    15     department shall accompany any decision on a petition by the
    16     local authorities.
