                                     AN ACT

     1  Amending Title 35 (Health and Safety) of the Pennsylvania
     2     Consolidated Statutes, providing for the Pennsylvania
     3     Emergency Grant Program; and making an appropriation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 35 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7321.  Pennsylvania Emergency Grant Program.
     9     (a)  Creation.--There is hereby created within the
    10  Pennsylvania Emergency Management Agency the Pennsylvania
    11  Emergency Grant Program which shall provide grants to eligible
    12  applicants for the purpose of recovering costs incurred during
    13  dramatic rescue operations.
    14     (b)  Payment of grants.--The agency shall review annually,
    15  all applications received, on a form and in a manner prescribed
    16  by the agency, under this section and make grants to municipal
    17  police and fire departments, volunteer fire companies and other
    18  eligible emergency service providers, as determined by the


     1  agency, for recovery of eligible costs incurred during dramatic
     2  rescue operations.
     3     (c)  Eligibility criteria.--Only costs incurred by eligible
     4  applicants during dramatic rescue operations are eligible for
     5  recovery through the program. Eligible costs, which shall be
     6  determined by the agency, shall include, but not be limited to,
     7  overtime pay for permanent full-time and other full-time
     8  employees or members, disposable materials and supplies consumed
     9  and expended during a dramatic rescue operation and repair costs
    10  for equipment damaged during a dramatic rescue operation.
    11     (d)  Grant limitations.--The amount of each PEN Grant awarded
    12  shall be determined by the agency, based on need, but shall not
    13  exceed 50% of the eligible costs borne by the grantee during a
    14  dramatic rescue operation.
    15     (e)  Fund.--There is hereby established a nonlapsing
    16  restricted receipts account in the State Treasury to be known as
    17  the Pennsylvania Emergency Grant Fund. The fund shall consist of
    18  moneys appropriated by the General Assembly and additional
    19  moneys appropriated annually to the Pennsylvania Emergency
    20  Management Agency for the purpose of administering this section.
    21     (f)  Definitions.--As used in this section, the following
    22  words and phrases shall have the meanings given to them in this
    23  subsection:
    24     "Dramatic rescue operation."  An operation involving one or
    25  more municipal police or fire departments, volunteer fire
    26  companies or other emergency services providers in which one or
    27  more persons is rescued.
    28     "PEN Grant."  A grant provided through the Pennsylvania
    29  Emergency Grant Program.
    30     "Program."  The Pennsylvania Emergency Grant Program.

     1     Section 2.  The sum of $1,000,000, or as much thereof as may
     2  be necessary, is hereby appropriated to the Pennsylvania
     3  Emergency Management Agency for the fiscal year July 1, 1993, to
     4  June 30, 1994, to carry out the provisions of this act.
     5     Section 3.  This act shall take effect in 60 days.
