AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," providing for the teaching of
6 evolution.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 1516.2. Teaching of Evolution.--(a) In any public
13 school instruction concerning the theories of the creation of
14 man and the earth, and which involve the theory thereon commonly
15 known as evolution, a board of school directors may include as a
16 portion of such instruction the theory of creation as presented
17 in the Bible. Upon approval of the board of school directors,
18 any teacher may read such passages in the Bible as are deemed
19 necessary for instruction on the theory of creation, thereby
1 affording students a choice as to which such theory to accept.
2 (b) No teacher in a public school may stress any particular
3 denominational religious belief.
4 (c) This section shall not be construed as being adverse to
5 any decision which has been rendered by an appellate court.
6 Section 2. This act shall take effect in 60 days.
