                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for sale of armories
     3     and land and for the State Treasury Armory Fund.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1507 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1507.  Sale of unusable armories and land; sale or lease of
     9             timber and mineral rights.
    10     (a)  General rule.--
    11         (1)  Whenever, in the opinion of the Armory Board, any
    12  armory building, armory site, or other real estate owned by the
    13  Commonwealth is no longer suitable for military services due to
    14  change in population or to the needs of the military service,
    15  [it] the board may sell [it] the property in accordance with

     1  law.
     2         (2)  Whenever, in the opinion of the Armory Board, timber
     3     or other mineral rights at Fort Indiantown Gap, any State
     4     armory or any other military lands or facilities may be sold
     5     or leased without disruption of the usual military purposes
     6     of the property and without undue adverse impact upon the
     7     local environment, the board may sell or lease the rights in
     8     accordance with law.
     9     (b)  Disposition of proceeds.--[The] All money derived from
    10  [such] sale of [any armory building, armory site or other real
    11  estate] property under subsection (a)(1) or from sale or lease
    12  of rights under subsection (a)(2) shall be paid into the State
    13  Treasury Armory Fund.
    14     Section 2.  Section 1511(a) and (d)(1), (2) and (4) of Title
    15  51 are amended and subsection (d) is amended by adding a
    16  paragraph to read:
    17  § 1511.  State Treasury Armory Fund.
    18     (a)  Establishment.--There is hereby established in the State
    19  Treasury a special revenue fund to be known as the State
    20  Treasury Armory Fund. The proceeds from the sale of any armory
    21  building, armory site or other real estate used for the State
    22  military forces [and], the proceeds from the sale or lease of
    23  timber or other mineral rights at Fort Indiantown Gap or at any
    24  other real estate used for the State military forces and the
    25  proceeds from the rental of any State armories or other
    26  facilities used by the State military forces shall be deposited
    27  in the State Treasury Armory Fund.

    29     (d)  Expenditures from State Treasury Armory Fund.--The
    30  department may expend moneys from the State Treasury Armory Fund

     1  for the following purposes:
     2         (1)  Purchase of equipment, furniture and fixtures for
     3     State armories and other structures and facilities to be
     4     utilized by the Pennsylvania National Guard.
     5         (2)  Essential repairs and maintenance of State armories
     6     and other structures and facilities to be utilized by the
     7     Pennsylvania National Guard.
     8         * * *
     9         (4)  Construction of new armories and other structures
    10     and facilities to be utilized by the Pennsylvania National
    11     Guard.
    12         (5)  Support of environmental projects and programs at
    13     Fort Indiantown Gap, any State armory or any other military
    14     lands or facilities.
    15     Section 3.  This act shall take effect in 60 days.
