                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for continuing
     6     professional development.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1205.1(d) of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949, added
    11  December 15, 1986 (P.L.1602, No.178), is amended to read:
    12     Section 1205.1.  Continuing Professional Development.--* * *
    13     [(d)  All professional employes of school districts, joint
    14  school districts, intermediate units or area vocational-
    15  technical schools receiving their initial Pennsylvania teaching
    16  or administrative certification, as provided for in this
    17  article, on or after June 1, 1987, shall be required at least
    18  once during every five-year period, commencing upon receipt of a


     1  permanent teaching certificate or an initial administrative
     2  certificate, to participate in professional development activity
     3  pursuant to the professional development plan of that
     4  professional employe's school district, joint school district,
     5  intermediate unit or area vocational-technical school. A
     6  professional employe who obtains a professionally related
     7  master's degree shall be deemed to have complied permanently
     8  with the provisions of this subsection. The chief school
     9  administrator of every school district, joint school district,
    10  intermediate unit and area vocational-technical school shall
    11  certify annually to the secretary the names of professional
    12  employes who have received their initial Pennsylvania teaching
    13  or administrative certification on or after June 1, 1987, and
    14  the professional development activities in which these employes
    15  have participated. The certification shall be made at such time
    16  and in such form as the secretary may require.]
    17     (d)  All professional employes of school districts, joint
    18  school districts, intermediate units or area vocational-
    19  technical schools shall be required to participate in a
    20  professional development activity pursuant to the professional
    21  development plan of that professional employe's school district,
    22  joint school district, intermediate unit or area vocational-
    23  technical school at least once during every five-year period for
    24  the purpose of renewing teaching and administrative
    25  certification. For the purposes of this subsection, the first
    26  five-year period shall commence six months after the effective
    27  date of this subsection or on the first anniversary date of
    28  certification after the effective date of this subsection,
    29  whichever is sooner. The chief school administrator of every
    30  school district, joint school district, intermediate unit and

     1  area vocational-technical school shall certify annually to the
     2  Secretary of Education the names of professional employes and
     3  the professional development activities in which these employes
     4  have participated and also the names of any professional
     5  employes who have violated this subsection. Professional
     6  employes who have violated this subsection shall be suspended
     7  without pay from all duties until their certification has been
     8  properly renewed. Professional employes suspended under the
     9  provisions of this subsection shall not be eligible for
    10  employment in any other school district, joint school district,
    11  intermediate unit or area vocational-technical school until
    12  their certification has been properly renewed.

    14     Section 2.  This act shall take effect in 180 days.
