                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for driver improvement school.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 1538 of Title 75 of the Pennsylvania
     6  Consolidated Statutes is amended by adding a subsection to read:
     7  § 1538.  School, examination or hearing on accumulation of
     8             points or excessive speeding.

    10     (e)  Voluntary or court-ordered driver improvement school
    11  enrollment.--
    12         (1)  A person may attend an approved driver improvement
    13     school when that person's record for the first time shows as
    14     many as five points. In addition, a court of competent
    15     jurisdiction may require as the court deems appropriate that
    16     a person enroll in an approved driver improvement school. In
    17     either case, upon successful completion of the driver

     1     improvement course, two points shall be removed from the
     2     person's record and any fine payable upon conviction of the
     3     offense for which the points were assessed shall be reduced
     4     by the amount of the fee for the driver improvement course.
     5         (2)  The driver improvement course curriculum presented
     6     shall be that of the National Safety Council Defensive
     7     Driving Course, the National Corrective Training Institute
     8     Courses I and II or a substantially similar course of
     9     instruction.
    10         (3)  The fee for the driver improvement course under this
    11     subsection shall be $45. The department may annually review
    12     and increase the fee to reflect increased operational costs.
    13     The department shall publish any proposed cost change and
    14     related information in the Pennsylvania Bulletin three months
    15     prior to the proposed implementation of the cost change.
    16     Section 2.  This act shall take effect in 60 days.
