                                     AN ACT

     1  Amending the act of October 5, 1984 (P.L.734, No.159), entitled
     2     "An act requiring chemical identification of substances in
     3     the community and on employer premises; requiring the posting
     4     of the identity of these substances by employers and the
     5     labeling of chemicals; requiring information and safety data
     6     on chemicals to be given to the Department of Labor and
     7     Industry, members of the community and employees; requiring
     8     employers to operate educational programs relating to
     9     hazardous substances; providing for further duties of the
    10     Department of Labor and Industry, for complaint procedures,
    11     for investigations, for compliance orders and the enforcement
    12     thereof; and providing penalties," further providing for
    13     notice.

    14     The General Assembly of the Commonwealth of Pennsylvania
    15  hereby enacts as follows:
    16     Section 1.  Section 7 of the act of October 5, 1984 (P.L.734,
    17  No.159), known as the Worker and Community Right-to-Know Act, is
    18  amended by adding a subsection to read:
    19  Section 7.  Notice.

    21     (c)  Multiple workplace buildings.--In the case of a building
    22  containing the workplaces of two or more employers or tenants:


     1         (1)  Employers or tenants, as well as any contractors or
     2     subcontractors doing work or renovation, shall provide to the
     3     owner or landlord of the building all information required in
     4     subsection (a) and the respective Material Safety Data
     5     Sheets.
     6         (2)  The owner or landlord shall be responsible to post
     7     in a readily viewable area of the building a listing of
     8     potentially hazardous chemicals or substances including the
     9     employer's or tenant's name and location where the chemical
    10     is used or stored.
    11         (3)  The owner or landlord shall maintain the MSDS's for
    12     all potentially hazardous chemicals or substances in that
    13     manner and area where employees, during the course of a
    14     normal day of work, have access which does not depend on the
    15     permission or intervention of the employers or tenants or the
    16     owner or landlord.
    17         (4)  The owner or landlord shall make available, upon the
    18     request of emergency response personnel or firefighters, all
    19     information collected and maintained under this subsection.
    20         (5)  Employees of buildings specified in this subsection
    21     may make written inquiries concerning chemicals in the
    22     workplaces of employers or tenants.
    23         (6)  The owner or landlord shall forward employees'
    24     written chemical inquiries, on forms developed by the
    25     department, to the respective employer or tenant concerning
    26     questions regarding chemicals in the workplace.
    27         (7)  The employer or tenant has 15 working days to
    28     respond to an employee's request for information under this
    29     subsection. A copy of this response shall be forwarded to the
    30     owner or landlord who shall maintain the response in that

     1     manner and area where employees or employers or tenants
     2     during the course of a normal day of work, have access which
     3     does not depend on the permission or intervention of the
     4     employers or tenants or the owner or landlord.
     5     Section 2.  This act shall take effect in 60 days.
