AN ACT 1 Amending the act of July 28, 1988 (P.L.556, No.101), entitled 2 "An act providing for planning for the processing and 3 disposal of municipal waste; requiring counties to submit 4 plans for municipal waste management systems within their 5 boundaries; authorizing grants to counties and municipalities 6 for planning, resource recovery and recycling; imposing and 7 collecting fees; establishing certain rights for host 8 municipalities; requiring municipalities to implement 9 recycling programs; requiring Commonwealth agencies to 10 procure recycled materials; imposing duties; granting powers 11 to counties and municipalities; authorizing the Environmental 12 Quality Board to adopt regulations; authorizing the 13 Department of Environmental Resources to implement this act; 14 providing remedies; prescribing penalties; establishing a 15 fund; and making repeals," requiring State agencies and 16 offices to purchase recycled paper products containing 17 postconsumer waste. 18 The General Assembly of the Commonwealth of Pennsylvania 19 hereby enacts as follows: 20 Section 1. Sections 1508(a) and 1511 of the act of July 28, 21 1988 (P.L.556, No.101), known as the Municipal Waste Planning, 22 Recycling and Waste Reduction Act, are amended to read: 23 Section 1508. Procurement options for local public agencies and
1 certain Commonwealth agencies. 2 (a) General rule.--This section sets forth procurement 3 options for local public agencies. These procurement options are 4 also available to Commonwealth agencies other than the 5 Department of General Services, except as specified in section 6 1511. 7 * * * 8 Section 1511. Recycled paper products. 9 (a) General rule.--The Department of General Services and 10 all other Commonwealth agencies shall, to the fullest extent 11 possible when contracting for paper or paper products, purchase 12 or approve for purchase only such paper or paper products [that] 13 as are manufactured or produced from recycled paper as specified 14 in subsection (b). 15 (b) Implementation.--The provisions of subsection (a) shall 16 be implemented by the Department of General Services and all 17 other Commonwealth agencies so that, of the total volume of 18 paper purchased, recycled paper composes at least 10% of the 19 volume in 1989, at least 25% of the volume in 1991 [and], at 20 least [40%] 60% of the volume in [1993] 1994, and at least 75% 21 in 1995. 22 (c) Newsprint.--In the case of the purchase of newsprint and 23 newsprint products, at least [40%] 50% of the secondary waste 24 paper material used in recycled newsprint shall be postconsumer 25 newspaper waste. 26 (d) Application of section.--This section shall not apply to 27 the purchase of paper containers for food or beverages. 28 (e) Labeling.--Office paper containing postconsumer 29 newspaper waste shall be labeled clearly identifying it as such 30 by use of a watermark, other symbol, or printed statement to 19930H1384B1516 - 2 -
1 facilitate sorting for recycling. 2 [(e)] (f) Definitions.--As used in this section, the 3 following words and phrases shall have the meanings given to 4 them in this subsection: 5 "Commonwealth agencies." Includes, but not limited to, 6 legislative and executive agencies. 7 "Office paper." Any writing, typing, computer, calculator, 8 photocopying, or other type of paper customarily used for 9 general office work. 10 "Postconsumer waste." Any product generated by a business or 11 consumer [which] that has served its intended end use, [and 12 which] has been separated from solid waste for the purposes of 13 collection, recycling, and disposition, and [which] does not 14 include secondary waste material or demolition waste. 15 "Recycled paper." Any paper having a total weight consisting 16 of not less than 20% secondary waste paper material in 1989, not 17 less than 30% of said material in 1991[, not less than 40% of 18 said material in 1993, and not less than 50% of said material in 19 1996 and thereafter, and not less than 10% postconsumer waste 20 beginning in 1996.] and thereafter, and not less than 10% 21 postconsumer waste in 1994, 20% postconsumer waste in 1995, and 22 25% postconsumer waste in 1996 and thereafter. Paper containing 23 at least 20% postconsumer waste need not contain secondary waste 24 paper material in order to be defined as recycled paper. 25 "Secondary waste paper material." Paper waste generated 26 after the completion of a papermaking process, such as 27 postconsumer waste material, envelope cuttings, bindery 28 trimmings, printing waste, cutting and other converting waste, 29 butt rolls, and mill wrappers. The term shall not include 30 fibrous waste generated during the manufacturing process, such 19930H1384B1516 - 3 -
1 as fibers recovered from wastewater or trimmings of paper 2 machine rolls, fibrous by-products of harvesting, extractive, or 3 woodcutting [process] processes, or forest residue such as bark. 4 Section 2. This act shall take effect in 180 days. C22L27SFG/19930H1384B1516 - 4 -
