AN ACT 1 Amending the act of December 19, 1990 (P.L.1200, No.202), 2 entitled "An act providing for the registration and 3 regulation of solicitations by charitable organizations, 4 professional fundraisers and other solicitors; imposing 5 additional powers on the Department of State and the Office 6 of Attorney General; prescribing civil and criminal 7 penalties; and making a repeal," providing for library 8 organizations. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 6(a)(4) of the act of December 19, 1990 12 (P.L.1200, No.202), known as the Solicitation of Funds for 13 Charitable Purposes Act, amended July 9, 1992 (P.L.436, No.92), 14 is amended to read: 15 Section 6. Exemptions from registration. 16 (a) General rule.--The following charitable organizations 17 shall be exempt from the registration requirements of this act: 18 * * * 19 (4) Public nonprofit library organizations which receive 20 financial aid from State and municipal governments and file
1 an annual fiscal report with the State Library System, as 2 well as any independently operated private nonprofit 3 organizations which possess tax exempt status under the 4 Internal Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. § 5 1 et seq.) that, pursuant to the organic documents under 6 which private nonprofit organizations are constituted, exist 7 solely to conduct fundraising and other activities in support 8 of a designated public nonprofit library organization, 9 provided that all fundraising activities are carried on by 10 volunteers, members or officers of the private organization 11 and these volunteers, members or officers receive no 12 compensation, directly or indirectly, for the activities. 13 * * * 14 Section 2.
