                                     AN ACT

     1  Amending the act of July 28, 1988 (P.L.556, No.101), entitled
     2     "An act providing for planning for the processing and
     3     disposal of municipal waste; requiring counties to submit
     4     plans for municipal waste management systems within their
     5     boundaries; authorizing grants to counties and municipalities
     6     for planning, resource recovery and recycling; imposing and
     7     collecting fees; establishing certain rights for host
     8     municipalities; requiring municipalities to implement
     9     recycling programs; requiring Commonwealth agencies to
    10     procure recycled materials; imposing duties; granting powers
    11     to counties and municipalities; authorizing the Environmental
    12     Quality Board to adopt regulations; authorizing the
    13     Department of Environmental Resources to implement this act;
    14     providing remedies; prescribing penalties; establishing a
    15     fund; and making repeals," further planning grants.

    16     The General Assembly of the Commonwealth of Pennsylvania
    17  hereby enacts as follows:
    18     Section 1.  Section 901 of the act of July 28, 1988 (P.L.556,
    19  No.101), known as the Municipal Waste Planning, Recycling and
    20  Waste Reduction Act, is amended to read:
    21  Section 901.  Planning grants.
    22     (a)  Counties.--The department shall, upon application from a
    23  county, award grants for the cost of preparing municipal waste
    24  management plans in accordance with this act; for carrying out

     1  related studies, surveys, investigations, inquiries, research
     2  and analyses, including those related by siting; and for
     3  environmental mediation. The department may also award grants
     4  under this section for feasibility studies and project
     5  development for municipal waste processing or disposal
     6  facilities, except for facilities for the combustion of
     7  municipal waste that are not proposed to be operated for the
     8  recovery of energy. The application shall be made on a form
     9  prepared and furnished by the department. The application shall
    10  contain such information as the department deems necessary to
    11  carry out the provisions and purposes of this act. The grant to
    12  any county under this section shall be 80% of the approved cost
    13  of such plans and studies.
    14     (b)  Other municipalities.--
    15         (1)  The department may grant sums of not more than
    16     $50,000 to other municipalities to assist in funding studies
    17     of health, transportation, geographic and other issues
    18     required in connection with construction of municipal waste
    19     processing and disposal facilities.
    20         (2)  At least two public hearings shall be held on each
    21     study to hear testimony of local citizens and businesses.
    22         (3)  The sum of $2,000,000 is hereby appropriated from
    23     the General Fund to the Department of Environmental Resources
    24     to be used to fund grants under this subsection.
    25     Section 2.  This act shall take effect in 60 days.
