AN ACT
1 Amending Title 74 (Transportation) of the Pennsylvania
2 Consolidated Statutes, further providing for the public
3 transportation assistance fund.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1314(f) of Title 74 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 1314. Public Transportation Assistance Fund.

10 (f) Motor vehicle rental fee.--
11 (1) There is hereby imposed on each rental of a motor
12 vehicle subject to tax under Article II of the Tax Reform
13 Code of 1971 a fee of $2 for each day or part of a day for
14 which the vehicle is rented.
15 (2) The fee shall not be imposed on the rental of a
16 replacement vehicle.
1 (3) As used in this subsection, the term "replacement
2 vehicle" means a vehicle that is rented temporarily to
3 replace a motor vehicle which is undergoing repairs.

5 Section 2. The Department of Revenue shall promulgate
6 regulations to implement and administer this act.
7 Section 3. This act shall be retroactive to October 1, 1991.
8 Section 4. This act shall take effect immediately.
