                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, further providing for the qualifications for and
     3     the issuance of junior hunting or furtaker licenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 2704(a), 2705 and 2711(a)(6) of Title 34
     7  of the Pennsylvania Consolidated Statutes are amended to read:
     8  § 2704.  Eligibility for license.
     9     (a)  General rule.--Persons meeting the requirements of this
    10  title who [are 12 years of age or] have reached or will reach
    11  their 12th birthday in the calendar year of application or who
    12  are older, whose hunting and furtaking privileges are valid and
    13  who shall meet the application requirements set forth in this
    14  title and pay the prescribed license cost and issuance fee shall
    15  be eligible to obtain the applicable hunting or furtaking
    16  license.

    18  § 2705.  Classes of licenses.

     1     Unless otherwise provided, any person wishing to exercise any
     2  of the privileges granted by this title shall first secure the
     3  applicable resident or nonresident hunting or furtaker license
     4  as follows:
     5         (1)  Adult resident hunting licenses to residents who
     6     have reached their 17th birthday but have not reached their
     7     65th birthday.
     8         (2)  Junior resident hunting licenses to residents who
     9     have reached or will reach their 12th birthday in the
    10     calendar year of application for a license but who have not
    11     reached their 17th birthday prior to the date of the
    12     application for the license and who present a written
    13     request, bearing the signature of a parent or guardian, for
    14     the issuance of a license. The actual hunting privileges
    15     granted to the holder of a junior license shall not be
    16     exercised until that person in fact is 12 years of age.
    17         (3)  Senior resident hunting licenses or, at the option
    18     of the applicant, a senior lifetime resident hunting license
    19     to residents who have reached or will reach their 65th
    20     birthday in the year of the application for the license. The
    21     commission shall develop, implement and administer a system
    22     to provide tags, report cards and applications to those
    23     residents who hold a senior lifetime resident hunting license
    24     issued under this paragraph. The system shall require the
    25     applicant or license holder to pay any approved fee assessed
    26     by the issuing agent.
    27         (4)  Adult resident furtaker licenses to residents who
    28     have reached their 17th birthday but have not reached their
    29     65th birthday.
    30         (5)  Junior resident furtaker licenses to residents who

     1     have reached or will reach their 12th birthday in the
     2     calendar year of application for a license but who have not
     3     reached their 17th birthday prior to the date of the
     4     application for the license and who present a written
     5     request, containing the signature of a parent or guardian,
     6     for the issuance of a license. The actual furtaking
     7     privileges granted to the holder of a junior license shall
     8     not be exercised until that person in fact is 12 years of
     9     age.
    10         (6)  Senior resident furtaker licenses or, at the option
    11     of the applicant, a senior lifetime resident furtaker license
    12     to residents who have reached or will reach their 65th
    13     birthday in the year of the application for the license.
    14         (7)  (Reserved).
    15         (8)  Adult nonresident hunting licenses to all
    16     nonresidents of 17 years of age or older.
    17         (9)  Junior nonresident hunting licenses to all
    18     nonresidents who have reached or will reach their 12th
    19     birthday in the calendar year of application for a license
    20     but who have not reached their 17th birthday prior to the
    21     date of the application for the license and who present a
    22     written request, bearing the signature of a parent or
    23     guardian, for the issuance of a license. The actual hunting
    24     privileges granted to the holder of a junior license shall
    25     not be exercised until that person in fact is 12 years of
    26     age.
    27         (10)  Adult nonresident furtaker licenses to nonresidents
    28     of 17 years of age or older.
    29         (11)  Junior nonresident furtaker licenses to
    30     nonresidents who have reached or will reach their 12th

     1     birthday in the calendar year of application for a license
     2     but who have not reached their 17th birthday prior to the
     3     date of the application for the license and who present a
     4     written request, containing the signature of a parent or
     5     guardian, for the issuance of a license. The actual furtaking
     6     privileges granted to the holder of a junior license shall
     7     not be exercised until that person in fact is 12 years of
     8     age.
     9         (12)   Seven-day nonresident small game license to
    10     persons eligible to procure a nonresident hunting license.
    11     The license shall be valid for a period of seven consecutive
    12     days. The holder of the license shall be entitled to hunt
    13     for, take or kill crows and small game.
    14         (13)  Antlerless deer licenses, bear licenses, archery
    15     licenses, muzzleloader licenses and any other license
    16     required to insure just and proper administration of this
    17     title and sound game or wildlife conservation to eligible
    18     persons, subject to the regulations, requirements and
    19     conditions which the commission shall establish. Any such
    20     license shall be made available to residents serving on
    21     active duty in the armed forces of the United States or in
    22     the United States Coast Guard without regard to quota
    23     limitations or application deadlines.
    24  § 2711.  Unlawful acts concerning licenses.
    25     (a)  General rule.--Except as otherwise provided in this
    26  title, it is unlawful for any person to:

    29     (relating to classes of licenses), receive a hunting or
    30     furtaking license under any circumstances if under 12 years

     3     Section 2.  This act shall apply to the license year
     4  beginning July 1, 1993, and to each license year thereafter.
     5     Section 3.  This act shall take effect immediately.
