AN ACT
1 Amending the act of July 22, 1974 (P.L.589, No.205), entitled
2 "An act relating to unfair insurance practices; prohibiting
3 unfair methods of competition and unfair or deceptive acts
4 and practices; and prescribing remedies and penalties,"
5 further prohibiting unfair practices relating to certain
6 adopted minor children with disabilities.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of July 22, 1974 (P.L.589, No.205), known
10 as the Unfair Insurance Practices Act, is amended by adding a
11 section to read:
12 Section 5.1. Adopted Children with Special Needs.--(a) It
13 shall be an unfair insurance practice and a violation of this
14 act for the health care insurer of a person or family to exclude
15 from coverage or reduce the amount of coverage of health
16 insurance for any adopted minor child with a disability of that
17 person or family, or of any minor child with a disability
18 subject to pending adoption proceedings initiated by that person
19 or family.
1 (b) As used in this section, "minor child with a disability"
2 shall mean a minor child with a physical, mental or emotional
3 disability.
4 Section 2. This act shall take effect in 60 days.
