                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, further providing for the use of daylight orange
     3     safety material.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2524 of Title 34 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2524.  Protective material required.
     9     (a)  General rule.--Unless further restricted by regulations
    10  of the commission, every person hunting for or assisting to hunt
    11  for deer, bear or woodchucks shall wear either a minimum of 250
    12  square inches of daylight fluorescent orange-colored material on
    13  the back and front combined or, in lieu thereof, a hat of the
    14  same color material. The material shall be worn so it is visible
    15  in a 360-degree arc. [Unless] Except as provided in subsection
    16  (b) and unless otherwise specified by regulations of the
    17  commission, the provision of this section shall not apply to any
    18  season for using muzzle-loading firearms only or season for

     1  using bows and arrows only.
     2     (b)  Fall archery season for deer.--Whenever the fall archery
     3  season for deer coincides with or continues into the regular
     4  fall season for taking small game, any person hunting for or
     5  assisting to hunt for deer shall wear either a minimum of 100
     6  square inches of daylight fluorescent orange-colored material on
     7  the back or front combined or, in lieu thereof, a hat of the
     8  same color material.
     9     [(b)] (c)  Penalty.--A violation of this section is a summary
    10  offense of the fifth degree.
    11     Section 2.  This act shall take effect July 1, 1993.
