                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for a two-thirds vote of
     6     members of the board for major new construction.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 508 of the act of March 10, 1949 (P.L.30,
    10  No.14), known as the Public School Code of 1949, amended January
    11  14, 1970 (1969 P.L.468, No.192), is amended to read:
    12     Section 508.  Majority Vote Required; Recording.--(a)  The
    13  affirmative vote of a majority of all the members of the board
    14  of school directors in every school district, duly recorded,
    15  showing how each member voted, shall be required in order to
    16  take action on the following subjects:--
    17     Fixing length of school term.
    18     Adopting textbooks.


     1     Appointing or dismissing district superintendents, assistant
     2  district superintendents, associate superintendents, principals,
     3  and teachers.
     4     Appointing tax collectors and other appointees.
     5     Adopting the annual budget.
     6     Levying and assessing taxes.
     7     Purchasing, selling, or condemning land.
     8     Locating new buildings or changing the locations of old ones.
     9     Dismissing a teacher after a hearing.
    10     Creating or increasing any indebtedness.
    11     Adopting courses of study.
    12     Establishing additional schools or departments.
    13     Designating depositories for school funds.
    14     Entering into contracts of any kind, including contracts for
    15  the purchase of fuel or any supplies, where the amount involved
    16  exceeds one hundred dollars ($100).
    17     Fixing salaries or compensation of officers, teachers, or
    18  other appointees of the board of school directors.
    19     Entering into contracts with and making appropriations to the
    20  intermediate unit for the district's proportionate share of the
    21  cost of services provided or to be provided for by the
    22  intermediate unit.
    23     Failure to comply with the provisions of this section shall
    24  render such acts of the board of school directors void and
    25  unenforcible.
    26     (b)  Notwithstanding subsection (a), the affirmative vote of
    27  two-thirds of all the members of the board of school directors
    28  in every school district, duly recorded, showing how each member
    29  voted, shall be required in order to take action on major new
    30  construction. The term "major new construction" includes new

     1  construction or a substantial addition as defined in section
     2  701.1.
     3     Section 2.  This act shall take effect in 60 days.
