                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for trading in motor
     3     vehicles and trailers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7365 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 7365.  Trading in motor vehicles and trailers.
     9     (a)  Offense defined.--A person is guilty of a summary
    10  offense if he engages in the business of buying, selling,
    11  exchanging, trading, or otherwise dealing in new or used motor
    12  vehicles or trailers, other than a manufactured home, on Sunday.
    13     (b)  Repeated offense penalty.--A person who commits a second
    14  or any subsequent offense within one year after conviction for
    15  the first offense, shall be sentenced to pay a fine not
    16  exceeding $200.
    17     (c)  Definitions.--As used in this section, the following

     1  words and phrases shall have the meanings given to them in this
     2  subsection:
     3     "Manufactured home."  A structure, transportable in one or
     4  more sections, which in the traveling mode is eight body feet or
     5  more in width or 40 body feet or more in length or when erected
     6  on site is 320 or more square feet, and which is built on a
     7  permanent chassis and designed to be used as a dwelling with or
     8  without a permanent foundation when connected to the required
     9  utilities and includes the plumbing, heating, air-conditioning
    10  and electrical systems contained therein. Calculations used to
    11  determine the number of square feet in a structure will be based
    12  on the structure's exterior dimensions measured at the largest
    13  horizontal projections when erected on site. These dimensions
    14  will include all expandable rooms, cabinets and other
    15  projections containing interior space, but do not include bay
    16  windows.
    17     "Motor vehicle."  Every self-propelled device in, upon or by
    18  which any person or property is or may be transported or drawn
    19  on a public highway.
    20     "Trailer."  Every vehicle, without motor power, designed to
    21  carry property or passengers or designed and used exclusively
    22  for living quarters wholly on its own structure, and to be drawn
    23  by a motor vehicle. The term does not include a manufactured
    24  home.
    25     Section 2.  This act shall take effect in 60 days.
