           APRIL 19, 1994

                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     providing for designation of fire chiefs and deputy fire
     5     chiefs.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of June 23, 1931 (P.L.932, No.317), known
     9  as The Third Class City Code, reenacted and amended June 28,
    10  1951 (P.L.662, No.164), is amended by adding a section to read:
    11     Section 2101.1.  Designation of Fire Chief and Deputy Fire
    12  Chief.--The fire chief and deputy fire chief shall be designated  <--
    13  by the mayor and may be demoted without cause in the same         <--
    14  manner, but not to any rank lower than the rank which he held at
    15  the time of his designation as fire chief or deputy fire chief.
    16     Section 2.  Section 2102 of the act, amended November 9, 1965
    17  (P.L.670, No.328), is amended to read:
    18     Section 2102.  Paid Bureau; Election of Officers and

     1  Companies.--When a paid fire bureau is organized by any city,
     2  the council may provide, by ordinance, for the election or
     3  appointment of the officers and companies belonging thereto, in
     4  accordance with civil service provisions where applicable, with
     5  the exception of designation of the fire chief and deputy fire
     6  chief, which shall be performed by the mayor. The minimum annual
     7  starting salary or compensation to be paid the officers and
     8  firemen by any city shall be four thousand five hundred dollars
     9  ($4,500), with minimum annual increments of three hundred
    10  dollars ($300) for the first three years of such employment. If
    11  the annual salary or compensation of any fireman employed by the
    12  city on the effective date of this amending act is less than
    13  four thousand five hundred dollars ($4,500), such salary or
    14  compensation shall be increased to four thousand five hundred
    15  dollars ($4,500), and such fireman shall receive minimum annual
    16  increments of three hundred dollars ($300) for the next three
    17  years of such employment.
    18     Section 3.  This act shall take effect in 60 days.
