A JOINT RESOLUTION
1 Proposing an amendment to the Constitution of the Commonwealth
2 of Pennsylvania, further providing for pension or retirement
3 systems.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby resolves as follows:
6 Section 1. The following amendment to the Constitution of
7 Pennsylvania is proposed in accordance with Article XI:
8 That section 26 of Article III be amended to read:
9 § 26. Extra compensation prohibited; claims against the
10 Commonwealth; pensions.
11 (a) No bill shall be passed giving any extra compensation to
12 any public officer, servant, employee, agent or contractor,
13 after services shall have been rendered or contract made, nor
14 providing for the payment of any claim against the Commonwealth
15 without previous authority of law: Provided, however, That
16 nothing in this Constitution shall be construed to prohibit the
17 General Assembly from authorizing the increase of retirement
1 allowances or pensions of members of a retirement or pension 2 system now in effect or hereafter legally constituted by the 3 Commonwealth, its political subdivisions, agencies or 4 instrumentalities, after the termination of the services of said 5 member. 6 (b) Notwithstanding the provisions of section 8 of Article 7 II and section 16 of Article V, nothing in this Constitution 8 shall be construed to prohibit the General Assembly from by law 9 creating classes of membership for a retirement or pension 10 system now in effect or hereafter constituted by the 11 Commonwealth for officers and employees of the Legislative 12 Department, Executive Department or Judicial Department and 13 political subdivisions, agencies or instrumentalities or, from 14 time to time, specifying appropriate contribution rates, 15 retirement allowances or pension benefits applicable to each 16 class so created; nor is the General Assembly prohibited from 17 prospectively altering or qualifying contribution rates or other 18 factors, retirement allowances or pension benefits for existing 19 officers or employees prior to the termination of service of 20 such officers or employees, or from altering or qualifying 21 contribution rates or other factors, retirement allowances or 22 pension benefits for officers or employees who become eligible 23 for membership in the retirement or pension system following the 24 effective date of such alteration or qualification. 25 Section 2. This proposed amendment shall be submitted by the 26 Secretary of the Commonwealth to the qualified electors of this 27 Commonwealth at the primary, general or municipal election next 28 held after the advertising requirements of section 1 of Article 29 XI of the Constitution of Pennsylvania have been satisfied.
