AN ACT
1 Amending the act of August 9, 1955 (P.L.323, No.130), entitled
2 "An act relating to counties of the third, fourth, fifth,
3 sixth, seventh and eighth classes; amending, revising,
4 consolidating and changing the laws relating thereto,"
5 regulating location of criminal records.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Section 405 of the act of August 9, 1955
9 (P.L.323, No.130), known as The County Code, is amended by
10 adding a subsection to read:
11 Section 405. Location of Offices, Records and Papers.--* * *
12 (d) The foregoing shall not preclude sentencing of
13 individuals convicted of criminal offenses outside of the county
14 seat. However, any records which are necessary for the
15 sentencing, including, but not limited to, transcripts of the
16 sentencing hearing, must be deposited in the county seat within
17 five business days. In no case shall failure to comply with this
18 section be the basis for overturning an otherwise appropriate
19 sentence.
1 Section 2. This act shall take effect in 60 days.
