AN ACT
1 Providing for a Statewide referendum on the question of whether
2 Pennsylvania should have a Returnable Beverage Container Act.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. The Secretary of the Commonwealth shall cause to
6 be placed on the ballot, at the primary or general election next
7 following the effective date of this act, a referendum to
8 determine the will of the electorate of the Commonwealth with
9 respect to the passage of a Returnable Beverage Container Act.
10 The referendum shall be advertised and conducted in accordance
11 with the provisions of the act of June 3, 1937 (P.L.1333,
12 No.320), known as the Pennsylvania Election Code.
13 Section 2. The question shall be in substantially the
14 following form:
15 Shall the General Assembly enact legislation, to be
16 entitled the Returnable Beverage Container Act, which
17 will place a nominal charge on every nonbiodegradable or
1 nonphotodegradable beverage container of 16 ounces or
2 less sold in this Commonwealth, with the charges
3 collected to be returned to consumers upon return of the
4 containers to recycling centers, retailers or beverage
5 manufacturers?
6 Section 3. This act shall take effect immediately.
