                               A JOINT RESOLUTION

     1  Proposing an amendment to the Constitution of the Commonwealth
     2     of Pennsylvania, further providing for the Governor's budgets
     3     and financial plan appropriations and surplus of operating
     4     funds.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby resolves as follows:
     7     Section 1.  The following amendment to the Constitution of
     8  Pennsylvania is proposed in accordance with Article XI:
     9     That sections 12, 13 and 14 of Article VIII be amended to
    10  read:
    11  § 12.  Governor's budgets and financial plan.
    12     Annually, at the times set by law, the Governor shall submit
    13  to the General Assembly:
    14     (a)  A balanced operating budget for the ensuing [fiscal
    15  year] biennium setting forth in detail (i) proposed expenditures
    16  classified by department or agency and by program and (ii)
    17  estimated revenues from all sources. If estimated revenues and


     1  available surplus are less than proposed expenditures, the
     2  Governor shall recommend specific additional sources of revenue
     3  sufficient to pay the deficiency and the estimated revenue to be
     4  derived from each source;
     5     (b)  A capital budget for the ensuing [fiscal year] biennium
     6  setting forth in detail proposed expenditures to be financed
     7  from the proceeds of obligations of the Commonwealth or of its
     8  agencies or authorities or from operating funds; and
     9     (c)  A financial plan for not less than the next succeeding
    10  [five fiscal years] three biennia, which plan shall include for
    11  each such [fiscal year] biennium:
    12     (i)  Projected operating expenditures classified by
    13  department or agency and by program, in reasonable detail, and
    14  estimated revenues, by major categories, from existing and
    15  additional sources, and
    16     (ii)  Projected expenditures for capital projects
    17  specifically itemized by purpose, and the proposed sources of
    18  financing each.
    19  § 13.  Appropriations.
    20     (a)  Operating budget appropriations made by the General
    21  Assembly shall not exceed the actual and estimated revenues and
    22  surplus available in the same [fiscal year] biennium.
    23     (b)  The General Assembly shall adopt a capital budget for
    24  the ensuing [fiscal year] biennium.
    25  § 14.  Surplus.
    26     All surplus of operating funds at the end of the [fiscal
    27  year] biennium shall be appropriated during the ensuing [fiscal
    28  year] biennium by the General Assembly.
