AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing for certain 4 additional public assistance eligibility requirements 5 relating to employment and job training. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The act of June 13, 1967 (P.L.31, No.21), known 9 as the Public Welfare Code, is amended by adding a section to 10 read: 11 Section 432.22. Additional Employment and Job Training 12 Requirements.--(a) Any transitionally needy person who claims 13 to be undergoing treatment for substance abuse shall be eligible 14 for assistance for the nine-month period following the initial 15 three-month period of assistance, only if the person meets all 16 of the following: 17 (1) Has been determined to be a substance abuser. 18 (2) Is officially registered with a substance abuse 19 treatment service licensed by the Department of Health.
1 (3) Is actively engaged in meaningful employment or is 2 enrolled in a job training program. 3 (4) Attends the drug treatment program sessions on a regular 4 basis. 5 (b) (1) In meeting the requirements of subsection (a)(3), 6 the department shall coordinate with the Department of Labor and 7 Industry to develop guidelines, standards and criteria relating 8 to meaningful work and job training, subject to clauses (2) and 9 (3). 10 (2) For the purpose of this section, meaningful work shall 11 include: 12 (i) Any full or part-time employment with a private 13 employer, as certified by the Department of Labor and Industry. 14 (ii) Any full or part-time employment with any public 15 agency, quasi-public agency or a community-based agency, engaged 16 in community development or other services to benefit the 17 community or the general public. This employment shall be 18 certified by the municipality or by the State agency which funds 19 or which otherwise retains any coordinating or supervisory 20 authority over the employing agency. 21 (3) For the purpose of this section, job training shall 22 include training with any public or private entity or agency, as 23 approved by the Department of Education, the Department of Labor 24 and Industry or other appropriate State agency. 25 (c) Nothing in this section shall affect eligibility for 26 medical assistance. 27 (d) The provision of this section shall be incorporated into 28 all contracts which the Commonwealth may enter into with any 29 public or private agency operating a substance abuse treatment 30 program. 19920H2772B3667 - 2 -
