                                     AN ACT

     1  Amending the act of October 18, 1988 (P.L.756, No.108), entitled
     2     "An act providing for the cleanup of hazardous waste sites;
     3     providing further powers and duties of the Department of
     4     Environmental Resources and the Environmental Quality Board;
     5     providing for response and investigations for liability and
     6     cost recovery; establishing the Hazardous Sites Cleanup Fund;
     7     providing for certain fees and for enforcement, remedies and
     8     penalties; and repealing certain provisions relating to the
     9     rate of the capital stock franchise tax," providing for a
    10     moratorium on certain incineration.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  The act of October 18, 1988 (P.L.756, No.108),
    14  known as the Hazardous Sites Cleanup Act, is amended by adding a
    15  section to read:
    16  Section 1301.1.  Moratorium on incineration.
    17     (a)  Period.--Incineration of hazardous material listed in
    18  this act, soil or other substances contaminated by petroleum or
    19  petroleum products, including crude oil or any fraction thereof
    20  shall be prohibited for a period of 18 months from the effective
    21  date of this section.


     1     (b)  Cessation of review.--The department is directed to
     2  immediately cease reviewing applications and cease issuing new
     3  permits for incineration of products prohibited under subsection
     4  (a) for a period of 18 months.
     5     (c)  Duties of department.--The department shall:
     6         (1)  Study and evaluate methods of incineration of
     7     contaminated and hazardous materials, soil and substances.
     8         (2)  Evaluate the effects that incineration of
     9     contaminated and hazardous materials, soils and other
    10     substances has on the public health, the environment and the
    11     economy.
    12         (3)  Evaluate current safety standards and propose any
    13     additional standards necessary to insure that the public
    14     health is not adversely affected by contaminated materials
    15     and substances incineration.
    16         (4)  Report its findings and recommendations to the
    17     Governor and the General Assembly as soon as possible and to
    18     make a final report on its findings and recommendations
    19     within 18 months.
    20     Section 2.  This act shall take effect immediately.
