                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     authorizing interest earnings on police pension
     5     contributions.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 4308 of the act of June 23, 1931
     9  (P.L.932, No.317), known as The Third Class City Code, reenacted
    10  and amended June 28, 1951 (P.L.662, No.164) and amended October
    11  4, 1978 (P.L.950, No.188), is amended to read:
    12     Section 4308.  Repayment Before Retirement.--If for any cause
    13  any member of the police force contributing to the pension fund
    14  shall cease to be a member of the force before he becomes
    15  entitled to a pension, the total amount of the contributions
    16  paid into the pension fund by such member shall be refunded to
    17  him in full, [without interest.] plus interest earned at the
    18  legal rate. If any such member shall have returned to him the
    19  amount contributed, and shall afterward again become a member of

     1  the police force, he shall not be entitled to the pension
     2  designated until twenty years after his reemployment, unless he
     3  shall return to the pension fund the amount withdrawn, in which
     4  event the period of twenty years shall be computed from the time
     5  the member first became a member of the police force, excluding
     6  therefrom any period of time during which the member was not
     7  employed by the police force. In the event of the death of a
     8  member of the police force not in the line of service before the
     9  member becomes entitled to the pension aforesaid and such member
    10  is not survived by a spouse or family entitled to payments as
    11  hereinbefore provided, the total amount of contributions paid
    12  into the pension fund by the member shall be paid over to his
    13  estate.
    14     Section 2.  This act shall take effect in 60 days.
