                                     AN ACT

     1  Amending the act of August 5, 1991 (P.L.182, No.23), entitled
     2     "An act amending Titles 24 (Education) and 71 (State
     3     Government) of the Pennsylvania Consolidated Statutes,
     4     further providing for the Public School Employees' Retirement
     5     System and the State Employees' Retirement System; adding and
     6     amending certain definitions; further providing for
     7     membership in the systems, for creditable nonschool and
     8     nonstate service and the purchase of credit, for incentives
     9     for special early retirement, for contributions to the
    10     retirement funds, for annuities and the rights and duties of
    11     annuitants, for health insurance premium assistance, for
    12     board membership and for the re-amortization and management
    13     of the retirement funds," further providing for retroactivity
    14     in relation to creditable nonschool service in the Cadet
    15     Nurse Corps.

    16     The General Assembly of the Commonwealth of Pennsylvania
    17  hereby enacts as follows:
    18     Section 1.  Section 31 of the act of August 5, 1991 (P.L.182,
    19  No.23), entitled "An act amending Titles 24 (Education) and 71
    20  (State Government) of the Pennsylvania Consolidated Statutes,
    21  further providing for the Public School Employees' Retirement
    22  System and the State Employees' Retirement System; adding and
    23  amending certain definitions; further providing for membership
    24  in the systems, for creditable nonschool and nonstate service

     1  and the purchase of credit, for incentives for special early
     2  retirement, for contributions to the retirement funds, for
     3  annuities and the rights and duties of annuitants, for health
     4  insurance premium assistance, for board membership and for the
     5  re-amortization and management of the retirement funds," is
     6  amended to read:
     7     Section 31.  The amendments of limitations on creditable
     8  nonschool service in the Cadet Nurse Corps (24 Pa.C.S. §
     9  8304(b)(8)) shall be retroactive to January 1, [1989] 1987, in
    10  order to be consistent with the amendment of 71 Pa.C.S. §
    11  5304(c)(6) by the act of October 21, 1988 (P.L.844, No.112),
    12  entitled "An act amending Titles 24 (Education) and 71 (State
    13  Government) of the Pennsylvania Consolidated Statutes, to
    14  include certain Federal service as nonstate service; further
    15  providing for special early retirement; providing for further
    16  supplemented annuities and for certain optional benefits; and
    17  further providing for compensation of the Public School
    18  Employees' Retirement Board," only to the extent that annuitants
    19  who were active members of the system on or after January 1,
    20  [1989] 1987, shall, notwithstanding any other provision of law,
    21  be eligible to purchase creditable nonschool service for service
    22  in the Cadet Nurse Corps, provided, however, that contributions
    23  by eligible annuitants on account of Class T-C credit for
    24  creditable nonschool service for service in the Cadet Nurse
    25  Corps shall be determined by applying the member's basic
    26  contribution rate plus the normal contribution rate as provided
    27  in 71 Pa.C.S. § 8328 at the time of the member's entry into
    28  school service subsequent to such creditable Cadet Nurse Corps
    29  service and multiplying the product by the number of years and
    30  fractional part of a year of creditable nonschool service being

     1  purchased together with statutory interest during all periods of
     2  subsequent school or State service, and time since most recent
     3  termination of school or State service to the date of purchase,
     4  and further provided that the purchased nonschool credit shall
     5  not be included in the calculation or payment of benefits for
     6  any period of time prior to the date of purchase.
     7     Section 2.  This act shall take effect immediately.
