AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, further providing for
3 costs in certain district justice cases.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 3571(c) of Title 42 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 3571. Commonwealth portion of fines, etc.

10 (c) Costs in district justice proceedings.--
11 (1) Costs collected by a district justice shall be
12 transmitted monthly to the Commonwealth in amounts as
13 prescribed in subsection (b) and the balance shall be
14 transmitted monthly to the county in which the magisterial
15 district is located. Costs transmitted to the Commonwealth
16 shall be credited to the General Fund. Costs transmitted to
17 the county shall be retained by the county for its use.
1 (2) Amounts payable to the Commonwealth:
2 (i) Summary conviction, except motor vehicle
3 cases............................................ $ 5.00
4 (ii) Summary conviction, motor vehicle cases
5 other than subparagraph (iii).................... $ 5.00
6 [(iii) Summary conviction, motor vehicle cases,
7 hearing demanded................................. $ 5.00]
8 (iii) Summary conviction, motor vehicle cases,
9 hearing demanded................................. $25.00
10 (iv) Misdemeanor............................ $ 7.00
11 (v) Felony.................................. $ 8.00
12 (vi) Assumpsit or trespass involving:
13 (A) $100 or less........................ $ 2.50
14 (B) More than $100 but not more than
15 $300......................................... $ 5.00
16 (C) More than $300 but not more than
17 $500......................................... $ 7.50
18 (D) More than $500...................... $10.00
19 (vii) Landlord-tenant proceeding............ $10.00
20 (viii) Objection to levy.................... $ 5.00
21 (ix) Order of execution..................... $10.00
22 (x) Issuing a search warrant (except as provided
23 in section 1725.1(d) (relating to costs))......... $ 7.00
24 (3) In all cases where costs are borne by the county
25 pursuant to section 1725.2 (relating to assumption of summary
26 conviction costs by county), no share of such costs shall be
27 payable to the Commonwealth.
