AN ACT 1 Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An 2 act relating to insurance; amending, revising, and 3 consolidating the law providing for the incorporation of 4 insurance companies, and the regulation, supervision, and 5 protection of home and foreign insurance companies, Lloyds 6 associations, reciprocal and inter-insurance exchanges, and 7 fire insurance rating bureaus, and the regulation and 8 supervision of insurance carried by such companies, 9 associations, and exchanges, including insurance carried by 10 the State Workmen's Insurance Fund; providing penalties; and 11 repealing existing laws," providing for certain additional 12 coverage in workmen's compensation insurance and for the 13 computation of workmen's compensation premium rates. 14 The General Assembly of the Commonwealth of Pennsylvania 15 hereby enacts as follows: 16 Section 1. The act of May 17, 1921 (P.L.682, No.284), known 17 as The Insurance Company Law of 1921, is amended by adding 18 sections to read: 19 Section 654.1. Certain provision required.--(a) All 20 insurers of liability under the act of June 2, 1915 (P.L.736, 21 No.338), known as "The Pennsylvania Workmen's Compensation Act," 22 shall be required to provide the coverage of surgical and
1 medical services, payment of medicine and supplies, hospital 2 treatment services and supplies, and orthopedic appliances and 3 prosthetics, mandated by said act, through a hospital plan 4 corporation certified pursuant to 40 Pa.C.S. § 6102 (relating to 5 certification of hospital plan corporations) and a professional 6 health service plan corporation certified pursuant to 40 Pa.C.S 7 § 6304 (relating to certification of professional health service 8 corporations). 9 (b) A person or institution providing treatment, 10 accommodations, products or services to an injured person for an 11 injury covered by "The Pennsylvania Workmen's Compensation Act," 12 shall not require, request or accept payment for the treatment, 13 accommodations, products or services in excess of the fee 14 schedules established by hospital plan corporations or 15 professional health service plan corporations. 16 Section 656. Premium Rates.--(a) Notwithstanding any 17 provision of this act, the premium rates for workmen's 18 compensation insurance for the construction industry shall be 19 computed on the number of worker hours for each manual rate 20 classification, instead of a percentage of the employer's 21 payroll, and the premium actually charged shall be a fixed sum 22 per hour worked. 23 (b) As used in this section, "construction industry" shall 24 include any activity in connection with the erection, 25 alteration, repair, replacement, renovation, installation or 26 demolition of any building, highway, bridge or structure. 27 Section 2.
