                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," providing for the acquisition of property for parks
     5     and recreation areas by right of eminent domain.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1901 of the act of May 1, 1933 (P.L.103,
     9  No.69), known as The Second Class Township Code, reenacted and
    10  amended July 10, 1947 (P.L.1481, No.567) and amended July 2,
    11  1953 (P.L.354, No.83), is amended to read:
    12     Section 1901.  Acquisition of Lands and Buildings.--The
    13  supervisors of any township may by ordinance separately or
    14  jointly designate and set apart for use as parks, playgrounds,
    15  playfields, gymnasiums, public baths, swimming pools, or indoor
    16  recreation centers, hereinafter called public parks, recreation
    17  areas and facilities, any lands or buildings, owned by such
    18  township, and not dedicated or devoted to other public use. Such
    19  township [may, in such manner as may be authorized or provided

     1  by law for the acquisition of lands or buildings for public
     2  purposes in such township, acquire lands or buildings therein
     3  for any of such purposes or construct and equip new facilities
     4  upon such lands or, if there be no law authorizing such
     5  acquisition, the township supervisors] may acquire lands or
     6  buildings for such purposes by gift or purchase or by the
     7  exercise of the right of eminent domain, or may lease lands or
     8  buildings in such township for temporary use for such purposes.
     9  Whenever the supervisors designate or acquire any lands, with or
    10  without buildings, under the provisions of this section, except
    11  when the acquisition is under a lease for temporary use, they
    12  may construct buildings and facilities thereon for the purposes
    13  herein indicated.
    14     Section 2.  This act shall take effect in 60 days.
