AN ACT 1 Amending the act of December 16, 1986 (P.L.1621, No.184), 2 entitled "An act establishing and imposing powers and duties 3 on the Office for the Deaf and Hearing Impaired in the 4 Department of Labor and Industry; and establishing and 5 providing powers and duties for the Advisory Council for the 6 Deaf and Hearing Impaired in the Department of Labor and 7 Industry," further providing for THE MEMBERSHIP OF THE <-- 8 COUNCIL, AND FOR the termination of the council. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 7 SECTIONS 5(A) AND (B) AND 7 of the act <-- 12 of December 16, 1986 (P.L.1621, No.184), entitled "An act 13 establishing and imposing powers and duties on the Office for 14 the Deaf and Hearing Impaired in the Department of Labor and 15 Industry; and establishing and providing powers and duties for 16 the Advisory Council for the Deaf and Hearing Impaired in the 17 Department of Labor and Industry," is ARE amended to read: <-- 18 SECTION 5. ADVISORY COUNCIL FOR THE DEAF AND HEARING IMPAIRED. <-- 19 (A) COUNCIL.--THE ADVISORY COUNCIL FOR THE DEAF AND HEARING
1 IMPAIRED, HEREIN REFERRED TO AS COUNCIL, IS CREATED WITHIN THE 2 DEPARTMENT OF LABOR AND INDUSTRY AND SHALL CONSIST OF [15] 17 3 MEMBERS AS FOLLOWS: THE SECRETARY OF PUBLIC WELFARE, THE 4 SECRETARY OF HEALTH, THE SECRETARY OF EDUCATION, THE SECRETARY 5 OF LABOR AND INDUSTRY, THE SECRETARY OF AGING, OR THEIR 6 DESIGNEES; THE GOVERNOR, OR HIS DESIGNEE; ONE MEMBER OF THE 7 HOUSE OF REPRESENTATIVES TO BE APPOINTED BY THE SPEAKER OF THE 8 HOUSE; ONE MEMBER OF THE SENATE TO BE APPOINTED BY THE PRESIDENT 9 PRO TEMPORE; AND [EIGHT] NINE MEMBERS OF THE PUBLIC TO BE 10 APPOINTED BY THE GOVERNOR. 11 (B) MEMBERS.--THE [EIGHT] NINE APPOINTED PUBLIC MEMBERS 12 SHALL BE INDIVIDUALS SELECTED FROM SCHOOLS, ORGANIZATIONS AND 13 NON-STATE AGENCIES WHICH RENDER SERVICES TO OR REPRESENT PERSONS 14 HAVING HEARING IMPAIRMENTS. AT LEAST FOUR OF THE PUBLIC MEMBERS 15 SHALL BE DEAF OR HEARING IMPAIRED. INITIALLY, THE GOVERNOR SHALL 16 DESIGNATE TWO OF THE PUBLIC MEMBERS TO SERVE ONE-YEAR TERMS, TWO 17 TO SERVE TWO-YEAR TERMS, TWO TO SERVE THREE-YEARS TERMS AND TWO 18 TO SERVE FOUR-YEAR TERMS. THEREAFTER, ALL APPOINTED MEMBERS 19 SHALL SERVE FOR FOUR YEARS. THE COUNCIL MEMBERS FROM STATE 20 OFFICES SHALL SERVE DURING THEIR TENURE IN OFFICE AND SHALL 21 REMAIN ON THE COUNCIL UNTIL SUCH TIME AS A REPLACEMENT IS NAMED 22 AND QUALIFIED. THE LEGISLATIVE MEMBERS OF THE COUNCIL SHALL 23 SERVE TWO-YEAR TERMS COMMENCING WITH THE FIRST TUESDAY IN 24 JANUARY OF ODD-NUMBERED YEARS AND MAY BE REAPPOINTED UPON 25 REELECTION TO OFFICE. THE INITIAL LEGISLATIVE MEMBERS' TERMS 26 WILL EXPIRE THE FIRST TUESDAY IN JANUARY 1987. 27 * * * 28 Section 7. Sunset. 29 The Advisory Council for the Deaf and Hearing Impaired shall 30 continue together with its statutory functions and duties until 19910H1981B2592 - 2 -
1 December 31, [1991] 2001, when it shall terminate and go out of
2 existence unless reestablished or continued by the General
3 Assembly. The evaluation, review, termination, reestablishment
4 and continuation of the agency shall be conducted pursuant to
5 the provisions of the act of December 22, 1981 (P.L.508,
6 No.142), known as the Sunset Act.
7 Section 2. This act shall take effect immediately.
