AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, requiring disclosure of ethnic origin
3 in marriage license applications in cities of the first
4 class.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 1302 of Title 23 of the Pennsylvania
8 Consolidated Statutes, added December 19, 1990 (P.L.1240,
9 No.206), is amended to read:
10 § 1302. Application for license.
11 (a) General rule.--No marriage license shall be issued
12 except upon written and verified application made by both of the
13 parties intending to marry.
14 (b) Contents.--The application shall contain the following:
15 (1) The full name of the applicants.
16 (2) The race, occupation, birthplace, residence and age
17 of the applicants.
18 (3) Whether the marriage contemplated is the first,
1 second or other marriage of an applicant.
2 (4) A statement that neither of the applicants is
3 afflicted with transmissible disease.
4 (5) The full name, residence, race, occupation and
5 birthplace of the parents of each applicant, including the
6 maiden name of the mother of each applicant.
7 (6) Any other facts necessary to determine whether a
8 legal impediment to the proposed marriage exists.
9 (7) In cities of the first class, the ethnic origin of
10 the applicants.
11 Section 2. This act shall take effect in 60 days.
