                                     AN ACT

     1  Amending the act of February 19, 1980 (P.L.15, No.9), entitled
     2     "An act establishing the State Real Estate Commission and
     3     providing for the licensing of real estate brokers and
     4     salesmen," further providing for continuing education.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 404.1 of the act of February 19, 1980
     8  (P.L.15, No.9), known as the Real Estate Licensing and
     9  Registration Act, added July 9, 1990 (P.L.338, No.77), is
    10  amended to read:
    11  Section 404.1.  Continuing education.
    12     (a)  The commission shall adopt, promulgate and enforce rules
    13  and regulations consistent with the provisions of this act
    14  establishing requirements of continuing education to be met by
    15  individuals licensed under this act less than ten years, as real
    16  estate brokers and real estate salespersons [under this act] as
    17  a condition for renewal of their licenses.
    18     (b)  The commission may waive all or part of the continuing
    19  education requirement imposed by subsection (a) for a

     1  salesperson or broker who shows evidence, to the commission's
     2  satisfaction, that he was unable to complete the requirement due
     3  to illness, emergency or hardship. [Such regulations]
     4     (c)  Regulations adopted under subsection (a) shall include
     5  any fees necessary for the commission to carry out its
     6  responsibilities under this section.
     7     [(b)] (d)  Beginning with the license period designated by
     8  regulation, each person licensed pursuant to this act less than
     9  ten years shall be required to obtain 14 hours of mandatory
    10  continuing education during each two-year license period. A
    11  [licensed] broker or salesperson licensed less than ten years
    12  who wishes to activate a license which has been placed on
    13  inactive status shall be required to document 14 hours of
    14  continuing education.
    15     [(c)] (e)  All courses, materials, locations and instructors
    16  shall be approved by the commission. No credit shall be given
    17  for any course in office management.
    18     [(d)] (f)  The commission shall initiate the promulgation of
    19  regulations to carry out the provisions of this section within
    20  six months of the effective date of this section.
    21     [(e)] (g)  The commission shall inform licensees [of] who are
    22  subject to the continuing education requirement of the
    23  requirement prior to the renewal period when continuing
    24  education is required. Each renewal notice thereafter shall
    25  include the following additional information:
    26         (1)  That licenses may be placed on inactive status for
    27     no more than five years.
    28         (2)  That individuals who have been licensed less than
    29     ten years must show evidence of 14 hours of continuing
    30     education in order to reactivate a license which has been

     1     placed on inactive status.
     2         (3)  The procedure and fee required for activating an
     3     inactive license.
     4         (4)  That a licensee who fails to activate his license
     5     after five years must retake the appropriate examination.
     6     Section 2.  This act shall take effect immediately.
